In Canada, federal law says that any antenna structure can be up to 15 metres
(about 45 feet) high without going through any approval process.  Anything
higher may require a fair bit of hoop-jumping.  This supercedes any local,
municipal, or provincial requirements (however may not supercede a requirement
for a building permit). I'm sure it also supercedes any private property
requirements, unless a contract is signed concerning it.  But even then an
ancient (middle 1800's) British law states that a contract cannot supercede any
federal or provincial law.  I have personally seen this upheld in a local
court, but not over an antenna structure.
