'ICC, UNSC should probe US in Amiri case'
Iranian academic Shahram Amiri, who was kidnapped by
Saudi and US intelligence agents last year, is on his way
back home from Washington.
Earlier in the day, Amiri talked to Press TV about his
ordeal, explaining how he was abducted in Saudi Arabia
while on pilgrimage last June and flown to the US.
He says he was under heavy psychological pressure in the
US. He also claims he was offered up to USD 10 million in
bribes by the Americans to cooperate with them against
Iran.
The revelations by Amiri came as officials in the US
spent the best pat of last year denying having any
knowledge about the Iranian academic's whereabouts.
This week, however, US Secretary of State Hillary Clinton
said that Amiri was in the US at his own will and was
free to leave whenever he wanted.
Iran has said it will pursue the Iranian scholar's case
through legal and diplomatic channels.
International lawyer Franklin Lamb joined Press TV to
explain about the legality of the matter and the measures
that can be taken to pursue such matters at international
courts.
Press TV: When you travel you carry a passport with you
and you have a travel record. How can the US claim that
Shahram Amiri was not kidnapped, when there is no proof
that he travelled to the United States by himself, of his
own free will, and was not abducted?
Franklin Lamb Well, it is certainly the curious case of
Mr. Sharam Amiri. It does have the earmarks -- from what
we know so far --- of an abduction. Given the pattern of
harassment in Saudi Arabia during religious pilgrimage by
the government against Shia worshippers, the initial
presumption is to credit Mr. Amir as we go forward in the
international community... ask the tough questions from
the Americans and I didn't personally find Hillary
Clinton's body language or her voice very convincing.
But let's have the visa application... let's have the
record from the interview that took place when he was
issued a visa and what about his ticket and when he
arrived in the States, where did he arrive and where are
the immigration forms? Any evidence he was drugged? Was
he given medical treatment? And what about the
surveillance?
The Americans have many questions to answer and I think
the international community will demand those as the
family of Mr. Amiri weighs the legal actions. And the
[Iranian] government will presumably defend him and bring
a case on his behalf, starting with groups like the Human
Rights Council... At what point does this become a
challenge in terms of war and the use of force?
This is the kidnapping of a private citizen, so the
Security Council will presumably be asked to take a look
at this. But, there is also a jurisdiction under their
own statutes. If this is a kidnapping, it belongs in the
International Criminal Court. Even if the Americans do
not accept jurisdiction, it can be raised there... as it
could of course be raised in the International Court of
Justice; we can also see whether the General Assembly in
the UN would decide to adopt the case.
It is a fascinating case, we are going to see what the
facts are and how the Americans will answer to the
serious charges.
