Trials and Tribulations of the Second Amendment March: Late on the
evening of Day Two of the SHOT show, I was met by several members of the
gun industry and asked to have a private and serious discussion on the
Second Amendment March. They shared with me concerns that the march
would fail, and that, in the process, I would weaken the gun rights
movement. I listened with gritted teeth as they told me that the time
was not right for a march of this type, and that the gun owners of our
country would not follow it. They reasoned that I had less than 100 days
to earn all the money needed and that I would never make it. Inside, I
was furious. Outside, I remained calm and listened to everything they
had to say. You see, I've been listening to these same arguments for
almost a year now. One usually expects discouragement from the enemy,
but not from one's own team members. In retrospect, I don't blame them
nor harbor any ill will. They're just acting the way they always have -
with fear and timidness. They've been on defense so long that they no
longer remember how to lead the charge... (I can't speak for others but
I had to wait late enough in life to carry firearms legally that I am
not inclined to go to DC, where I wouldn't be able to do so. I wonder if
the March can make provisions for its participants to store their
firearms, perhaps in Virginia.)

Lessons from Cuba: Cuba has given its few remaining armed citizens an
ultimatum. From the Associated Press: "Cuba has declared a two-month
amnesty for citizens to register unlicensed guns, and says those passing
aptitude and psychological tests will be allowed to keep their weapons.
The move is unusual in a state where almost no one except some active
military personnel and plain-clothed state security agents are allowed
to possess weapons." Even most police, we are told, are required to keep
their service weapons at their station when on leave (something those
with "Only Ones" attitudes here should take note of). We're also told
that guns Cubans retained after the "revolution" were, in large part,
confiscated. How? "[A]uthorities used a list of those who had sought
licenses to go door-to-door and encourage them to turn over their
firearms..." Ah, yes. Good ol' AP. I'm sure they were "encouraged." ...

Modern Racism: It's Black History Month. Jim Crow laws and slavery are
long gone. Only one former leader of the Ku Klux Klan remains in the
United States Senate. Yet racism thrives. It just appears a bit
different. Today's typical racist remarks are cloaked as compliments
from people in power, often expressing surprise that minorities are
talented, smart, attractive, and even "clean... In August, MSNBC
commentators pandered to racists, under a guise of opposing racism, with
their own racist reporting. A black man had peacefully protested a
pro-Obama health care rally in Phoenix. He was lawfully armed with two
guns. The network awkwardly cropped video of the man so tightly it was
impossible to see his skin. MSNBC's Contessa Brewer said: "The reason
we're talking about this, a lot of talk here gentlemen, is because
people feel like yes, there are Second Amendment rights, for sure. But
also there are questions about whether this has racial overtones. I
mean, here you have a man of color in the presidency and white people
showing up with guns strapped to their waists, or to their legs." ...

Later This Month...: Later this month, national park rules will change
dramatically, and for the better according to gun rights activists, when
it will become legal for park visitors to pack firearms for personal
protection in accordance with state laws in which a specific park is
located... There are limitations, of course. Armed citizens may not
carry guns inside buildings (i.e. ranger stations, visitor centers) and
under no circumstances does this mean that all of the national parks
will now open up to hunting and recreational shooting. Yes, it is true
that opponents of this change attempted to portray the regulatory shift
as throwing the doors open to irresponsible shooting and poaching. But
these are the same people who oppose concealed carry laws with
predictions of gunfights at traffic stops... On the national scale, park
visitors must remember that carrying firearms will depend on what the
applicable state statutes say.

Ohio Democrats Dump Pro-RKBA Candidate: Ohio democrats have removed
backing for secretary of state candidate Jennifer Garrison, driving her
out of the race. Her support of gun rights was cited as one reason why
according to the Cleveland Plain Dealer. "Garrison, a lawmaker from
Marietta, was urged by Gov. Ted Strickland last year to seek the office.
But since then Garrison's conservative stance on issues such as opposing
abortion rights and supporting gun rights, has riled some within the
Democratic base, especially labor groups. That forced party leadership
to push her out of the race." Garrison's political views have been
labeled as too conservative by some Democrats. Her opposition to gay
marriage was cited as another reason. Garrison was also attacked on
FaceBook when a group page was formed charging that "Garrison's record
is anti-GLBT, anti-equality, anti-choice, anti-labor, anti-worker, and
pro-gun. She is totally unacceptable" and one source railed that she
"supported unfettered gun rights to the point she received an 'A' rating
from the NRA." ... (In a state where the GOP has generally opposed the
RKBA, this seems like a particularly stupid move by the Democrats.)

South Carolina Passes States Rights Resolution: South Carolina
legislators have passed a measure lambasting Congress as overstepping
its constitutional bounds. The South Carolina House on Tuesday voted
86-27 to affirm its support of the Ninth and Tenth Amendments that limit
the scope of federal power, and gun rights under the Second Amendment.
The vote ended a week of debate. Democrats complained the resolution was
a pointless, political move to cull favor from conservative voters. They
argued sending messages to Washington does nothing to improve the lives
of South Carolinians. Republicans countered that Democrats were the ones
wasting time delaying and arguing against the measure. The House
initially approved it last year. The Senate approved an expanded version
last month.

Firearms Freedom Act Passed by Utah Senate: Guns made and kept in Utah
would be exempt from federal regulations under a measure the Utah Senate
gave its initial approval to Tuesday, despite concerns it could lead to
a costly legal fight in a lean budget year. Senate Bill 11 mirrors one
signed into law in Montana last year that's intended to trigger a
federal court battle. Both are intended to allow guns made in their
respective states to be exempt from rules on federal gun registration,
background checks and dealer-licensing. The goal is to circumvent
federal authority over interstate commerce, which is the legal basis for
most gun regulation in the United States. In the process, it could lead
to small arms dealers in the state operating with little to no
oversight. Sen. Margaret Dayton, R-Orem, said her bill is part of a
broader effort to send a message to Congress that the federal government
is overstepping its bounds... (Recall that Utah was the home of John

Delaware Legislature May Overturn Gun Ban: In response to a Caesar
Rodney Institute investigation, state lawmakers appear willing to
overturn the ban of gun ownership by residents who live in public
housing units plagued with crime. The institute's report, published
Monday, Feb. 1, said all four of the state's public housing authorities
ban their residents from owning firearms despite clear protections in
the Delaware Constitution, the Second Amendment to the U.S.
Constitution, Supreme Court decisions and recent rulings by lower courts
that have found similar bans to be unconstitutional. The report went on
to say that many public housing residents feel trapped in their homes
because of crime in their communities, since they are prohibited from
owning firearms for self-defense against the drug dealers and thugs who
infest their communities. Violating the gun ban can result in eviction.
After the report was published following a five-month investigation, the
Caesar Rodney Institute was told by members of all four legislative
caucuses that they would support legislation to overturn the gun bans...

Arizona Poised to Expand RKBA: Arizona has always held tightly to its
legacy as part of the gun-toting Wild West and a protector of individual
rights. This year, the state's Republican governor and a conservative
Legislature may continue that tradition by giving Arizonans some of the
least-restrictive weapons laws in the nation. This session, state
lawmakers have proposed more than a dozen bills on expanding rights to
carry and use guns and knives. The proposed laws would allow people to
carry concealed weapons without a permit, end requirements that guns
manufactured and kept in Arizona be registered, and allow university
professors to carry guns on school grounds. Although the number of bills
on the subject is not unusual, weapons-rights supporters believe this
year - with a conservative governor, a Legislature sympathetic to their
cause and more freedom to address issues other than the budget - may be
their year to lift many limits. It also is an election year, and gun
rights have always been a popular campaign platform among
conservatives... Only nine states have fewer gun restrictions than
Arizona, according to a scorecard released last year by the Brady
Campaign to Prevent Gun Violence, a gun-restriction advocacy group. If
some of the legislation is passed, Arizona will likely move lower on the

More Oklahoma Women Arm Themselves: The Second Amendment never sounded
so good. In lieu of police layoffs and having fewer officers on Tulsa
streets, more people are applying for a concealed carry license.
However, the look of students signing up is changing, because more women
are enrolling. In the last decade, weapons instructor, Robert Welch says
female enrollment has tripled. "they need it more than us guys do," said
Welch." "This is about personal self defense." Welch said obtaining a
concealed carry license is fairly simple. Students must attend an eight
hour course, which covers how to use a gun. Upon completion, students
must then apply for a license. Approval could take up to 90 days.
Licenses are valid for five years.

Bringing a Bat to a Gunfight: Police are looking for four people who
allegedly assaulted a man in Buckeye Tuesday, forcing him to pull out a
gun and shoot one of the suspects. According to Buckeye Lt. Jared
Griffith, the assault took place in the south parking lot of business
near 195th Avenue and Indian School Road. During the assault, Griffith
said the victim was beaten with a bat several times and sustained
injuries to his head and arms. In the middle of the attack, the victim
apparently pulled out a gun and shot one of the attackers in
self-defense... (Details are lacking so it's hard to say why the victim
delayed in drawing and using his handgun. A bat is a deadly weapon - its
blows can cripple or kill.)

Oops, Wrong Delivery Driver: A delivery driver turned the tables on a
couple of would-be robbers late Thursday night. Lexington Police say two
juveniles jumped the worker for China King outside an apartment building
on Laketower Drive, near Lakeshore Drive around 9:15 p.m. The delivery
man then pulled out a handgun, shooting one of the kids in the abdomen.
He went to the hospital to be treated for non life-threatening injuries,
according to police. The other suspect was taken into custody. Police
say the delivery driver hasn't been charged. (I assume that China King
is a restaurant.)

Oops, Wrong Parking Lot: ... The owner of a Kenner check-cashing store
shot and killed an alleged robber Friday night outside of his
establishment in the 3200 block of Williams Boulevard. Investigators say
the man was approached in a parking lot by three men as he left his
business just before 9pm. One member of the trio produced a gun and
struck the man in the head and then grabbed a backpack the victim had in
his possession. The intended victim retrieved the backpack, pulled a
gun from it and shot two of the suspects. One of the would-be robbers
was pronounced dead on the scene and the other was taken to a hospital
for treatment. The third man fled before police arrived. Authorities
say the two men who were shot carried identification cards from
Honduras... (It's a miracle that the victim was able to regain control
of his backpack. This is a good example of why I advise against off-body
carry, such as in purses or similar containers. The best place to carry
a handgun is in a holster.)

Oops, Wrong House, Arizona Version: ... Phoenix Police Sgt. Tommy
Thompson said 26-year-old Rudolph Gomes was seen breaking into a coin
operated car wash machine near Tatum Boulevard and Union Hills Drive
around 12:30 p.m. A witness apparently followed Gomes and called police.
At one point, Gomes reportedly struck a stop sign, damaging his vehicle.
Thompson said he parked his Jeep Cherokee in the parking lot of
Foothills Elementary School near Grovers Avenue and 44th Street and ran
into the neighborhood, according to witnesses. Officers arrived on the
scene and as they set up a perimeter and began searching the
neighborhood they heard a 'pop.' Police then received a call that a
homeowner had shot an armed intruder, Thompson said. According to
Thompson, the 59-year-old homeowner told police Gomes tried to rob him
at gunpoint and at some point he was able to get a shotgun and shoot the
intruder. The injured Gomes was taken to a local hospital where he died
of his injuries, Thompson said... (All's well that ends well but a
handgun in a holster is a better bet than a shotgun that has to be
retrieved.)

Oops, Wrong House, Oklahoma Version: Three intruders fled from an
Oklahoma City home this morning after being shot at by the home owner,
police said. The owner told police that he heard a noise at his front
door around 1:45 a.m. and opened the door. Three men armed with knives
forced their way into the home in the 6400 block of South Phillips
Avenue. The intruders forced the residents into a back bedroom when the
homeowner shot one of the intruders. The intruders fled in a
dark-colored SUV, police said. Police said the homeowner said he
recognized one of the suspects. Subsequently police arrested 30-year-old
Eric Kutz as well as a 14-year-old male. Police said Kutz was
transported to an area hospital to receive treatment for his injuries.
Upon release, Kutz will be interviewed by investigators. He is facing
charges robbery and assault charges. The 14-year-old was transported to
the Berry House and faces robbery charges as well...

Oops, Wrong House, Washington Version: Three men tried to break into a
home west of Yakima while the resident was home. The Yakima County
sheriff's office says he was on the phone to a dispatcher Sunday when a
brick came through the window. The homeowner armed himself with a
shotgun as the would-be burglar entered the house. When he saw the gun,
the intruder jumped into a getaway car. It sped off with the homeowner
firing three shots at the car. The third suspect fled on foot. A
sheriff's deputy and Union Gap police stopped and arrested two men in
the car. A Washington State Patrol trooper arrested the third man.

Does Action Beat Reaction?: When physicist Niels Bohr watched westerns,
he noticed that the cowboy who drew his gun first and so had an
advantage, was often the one shot. The Nobel laureate's favoured
solution to his "gunslinger's paradox" has now been confirmed in part:
people move faster when reacting than when they initiate the same
actions. Such reactive responses are about 21 milliseconds quicker than
planned actions, according to research. It means that the gunslinger who
draws last, draws faster. But it does not mean that you should wait for
your opponent to move first. While drawing and shooting might take less
time, any advantage is lost by the 200 milliseconds it takes the brain
to notice that the enemy has gone for his gun... Responsive actions are
also less accurate than planned ones, so you are more likely to miss the
target. The results suggest that making swift but rough responses might
have evolved as a defence against dangers such as predators or falling
trees... (The one conclusion I am comfortable about drawing from this
report is that it is foolish to stand in one place and try to beat

Brandishing: ... False reports of brandishing result from disappointed
criminals, the paranoid, the suspicious, the angry and the anti-gun. It
is good to have witnesses to the facts, but sometimes that is not as
helpful as it sounds. One defense witness refused to appear in court and
promised that if subpoenaed she would lie; the witness was the
defendant's sister. Witnesses may not want to get involved, or may want
to get involved on the other side. A peculiar loyalty has people come
out of the woodwork to declare that the citizen abused a local boy who
was "just getting his life together," which appears to be code for a
thug perfecting his craft. Actually, the more such persons come out of
the woodwork the less likely their stories seem. It is critical to be
the first person to relate events to the police. The first report sets
the tone for the case. The stock advice is to remain silent. This is
very good advice. However when the psychotic driver complains that he
was threatened with a gun for "no reason at all," silence implies
consent. It is essential that the citizen report every use of his gun,
even if nothing more than displaying the gun for the benefit of
threatening psychotics or thugs. This is where a cell phone beats a .45
as a self-defense tool. Nothing beats friendly witnesses, but this is
not always possible...

When Guns Are Outlawed...: A powerful handgun has been recovered at a
further education college during a police drugs search. The Baikal 9mm
pistol and ammunition were discovered when police, acting on detailed
intelligence, searched an 18-year-old student at Kingston College in
Kingston-upon-Thames, Surrey... The Baikal is a Russian-made handgun
designed to fire CS gas pellets and marketed in Eastern Europe as a
self-defence weapon. Lithuanian criminal gangs discovered that because
of its all-steel construction the Baikal could be easily converted to
fire live 9mm rounds. Hundreds of the guns have been converted and
smuggled into Britain where they became the "weapon of choice" for gangs
across the country. They were typically supplied with a silencer and
several rounds of commercially manufactured ammunition and have been
used in several murders, including that of James Andre Smartt-Ford, 16,
who was shot dead at Streatham Ice Rink, South London, three years ago...

As Goes Britain, So Goes Canada?: Combating a proliferation of knife
crimes would be easier if the province drafts legislation that edges
Saskatchewan closer to a provincewide knife ban, says Saskatoon police
Chief Clive Weighill. In meetings with provincial Justice Ministry
officials about new legislation, Weighill argued for a provision that
would allow police to seize a knife - or a sword or a machete - even if
it hasn't been used in a crime or there's no discernible intention to
commit an offence. "People can walk around Spadina (Crescent) carrying a
machete and an officer can't do anything about it unless someone walks
up and threatens someone," said Weighill. Police want the power to seize
that weapon before a crime, such as a threat or an assault, is
committed. Because some people use knives legitimately, police would
decide when a knife is a threat... (I have read accounts of British

Tangentially Related: Al Qaeda can be expected to attempt an attack on
the United States in the next three to six months, senior U.S.
intelligence officials told Congress on Tuesday. The terrorist
organization is deploying operatives to the U.S. to carry out new
attacks from inside the country, including "clean" recruits with a
negligible trail of terrorist contacts, CIA Director Leon Panetta said.
Al Qaeda is also inspiring homegrown extremists to trigger violence on
their own, Panetta added... Al Qaeda is increasingly relying on new
recruits with minimal training and simple devices to carry out attacks,
the CIA chief said as part of the annual assessment of national threats
provided to Congress by the top five U.S. intelligence officials.
Panetta also warned of the danger of extremists acting alone: "It's the
lone-wolf strategy that I think we have to pay attention to as the main
threat to this country," he said...

'God willing, our raids on you will continue," said Osama bin Laden - or
someone purporting to be him - in a message broadcast on al-Jazeera over
the weekend. The blunt message to "Obama from Osama" is intended to
reaffirm that, despite Barack Obama's overtures to the Islamic world, he
and his country remain infidels, every bit as evil as they were under
George W. Bush. But ignore the bloodcurdling rhetoric. That bin Laden
was reduced to claiming that the failed Christmas Day attempt to blow up
an airliner was comparable to 9/11 is a sign of al-Qaeda's current
parlous state. The new recording also revealed another weakness:
al-Qaeda fears that it is losing the battle for hearts and minds... For
those terrorists who remain at large, the operating environment has
become tough, as the unprecedented numbers of arrests and convictions in
the US and UK demonstrate. Politicians and security chiefs in most
Muslim countries have greatly increased their co-operation with Western
agencies. Today the US no-fly list for terror suspects stands at 4,000
names; before 9/11 it was just 16. But no security regime can ever be
perfect, as the attempt to detonate a device on Northwest Airlines
Flight 253 to Detroit shows. This was one of a series of strikes planned
by al-Qaeda in the past 12 months. We saw the targeting of the New York
subway system last autumn and the Fort Hood shooting. In Saudi Arabia
al-Qaeda terrorists carried out an abortive suicide attack against
Prince Muhammad bin Nayef, the Deputy Interior Minister. Its greatest
recent strategic coup was a suicide bombing that killed seven CIA
officers at a US forward base in Khost, Afghanistan... (My take - the
seeds have been planted and we are moving into an era of smaller,
lower-scale attacks, including many by home-grown jihadis. The latter
may be more likely to come to the attention of private citizens before
they come to the attention of the authorities.)

Committee on Monday, February 1, 2009. It passed out of committee by a
party line vote of 4-3.
SB 1102, the Senate version of the AzCDL-requested "Constitutional
Carry" bill, was also heard in the Senate Judiciary Committee on

about SB 1102. To that end, SB 1102 was amended in committee without
harming the underlying Constitutional Carry language. Changes were made
that:
- Corrected the language regarding the sale (versus destruction) of
confiscated weapons.
- Require CCW permit holders to have their permit and present it to law
enforcement upon request.
- Prevent law enforcement from confiscating a weapon lawfully possessed
by a permit holder.
- Modify the CCW permit training requirements to allow for NRA training,
military service, an existing permit, etc.
- Made other technical corrections.

A hostile amendment proposed by Senator Ken Cheuvront
(

committee hearing. This amendment would have required background checks
