Supremes Hear U.S. v. Hayes: A Second Amendment gun case that originated
in Marion County is now at the United States Supreme Court. The Highest
Court in the Nation began hearing arguments from the 2004 case of United
States vs. Hayes on Monday. The case revolves around a federal law that
makes it a crime to possess a gun after a misdemeanor crime of domestic
violence. The U.S. Supreme Court is expected to decide whether a
misdemeanor of simple battery fulfills the definition of domestic
violence. The Court will also decide if the law can be applied
retroactively since the conviction of battery happened back in 1994
before the federal statute was passed...

Brady Bunch Chimes In: ... The Court will interpret the federal
Lautenberg Amendment, which bans gun possession by convicted domestic
violence abusers. The Brady Center to Prevent Gun Violence and law
enforcement groups filed a brief in June urging the Court to reverse an
appeals court ruling that, if allowed to stand, could re-arm convicted
abusers in a majority of states... If the Supreme Court affirms the 4th
Circuit ruling, the names of thousands of dangerous, convicted abusers

v. Hayes was dense with debate over rules of grammar and statutory
interpretation, all aimed at figuring out what Congress meant when it
passed a statute in 1996 that expanded the scope of a law that makes it

Olofson Appeals Conviction: A Wisconsin man who contends he's been
imprisoned simply for loaning a broken gun to a friend, asserts in a new
court brief that the government's own witnessess support his claim.
David Olofson was convicted of transferring a machine gun, or a weapon
that releases more than one bullet with a single pull of the trigger,
and sentenced to 30 months in prison. But his case is on appeal to the
7th U.S. Circuit Court of Appeals, because his lawyers argue it was a
malfunctioning rifle, not a machine gun, that loosed the shots. The case
arose when Olofson loaned an Olympic Arms AR-15 semi-automatic rifle to
a friend, who fired it at a gun range. The weapon reportedly misfired,
letting loose several shots at the same time, and drew the interest of
authorities... (As I recall, Olofson had replaced the original safety
lever with a selector switch from an M16. This alone should not have
converted the AR-15 into a machine gun but, in hindsight, does not
appear to have been a wise choice.)

Big Brother Boosts Montana Gun Sales: President-elect Barack Obama won't
move into the Oval Office for months yet, but already he's providing a
big boost to at least one sector of Montana's economy. "Our sales are
way up," said Ray Strash, at Kalispell's Brass and Bullets. "I can't
even get any AR-15-style rifles. Everyone's out. The suppliers are all
back-ordered, and I told them, 'Don't even call us - just ship them as
soon as you can, because we'll take whatever we can get.' " Nationwide,

will be a federal firearms crackdown under the Obama administration. At

NSSF Comments: As firearm sales continue to increase this year, at a
rate of 10 percent over the same period last year and 15 percent in
October alone, the National Shooting Sports Foundation (NSSF) - the
trade association for the firearms industry - is pointing to gun-owner
concerns about an Obama Administration as reason for the boom. Last week
President-elect Obama's Web site had posted his administration's agenda
for curtailing the Second Amendment rights of law abiding Americans,

Rape Reports Boost Ohio CHL Courses: With reports of a possible serial
rapist in the loose in Central Ohio, many women in the area are
obtaining a concealed handgun license to be able to protect
themselves... Several gun shops in the area have reported a substantial
increase in the number of women taking training classes. The entire
situation is reminiscent of when in Louisiana in 2002 then Governor Mike
Foster told women "You have the right to get a gun permit...Learn to use
it" after a string of rapes and murders hit women in his state...

Oops, Wrong Gas Station: A man located Monday at a Citrus County
hospital is the wounded robbery suspect who was shot by a store clerk
during a Sunday evening hold-up, Gainesville police reported... Police
allege Rooks again tried to rob the Chevron station, 3328 W. University
Ave., on Sunday and fired a shot inside the business when a clerk
questioned his demands for cash. The clerk pulled out his own gun and
shot the suspect, hitting him in the upper torso. The robber fled the
store, firing shots as he left. Halvosa said Rooks had been in the
Gainesville area for the weekend and convinced friends he needed to be
taken to hospital after he was injured in a drug deal...

Oversize Purse Stops Bullet: Don't knock those trendy, oversized purses
- they could save your life, as one college student found out. Police
say the contents in an oversized purse saved Elizabeth Pittenger, a
22-year-old Middle Tennessee State University student, by stopping a
bullet during an attempted robbery. Pittenger was walking to her car on
campus Thursday evening when a man confronted her and demanded her
purse, cell phone and laptop, university Police Chief Buddy Peaster
said. She fought the man off, but he fired a shot before fleeing. The
bullet was found inside the purse, along with a calculator, umbrella and
small case that had been punctured. Pittenger was not injured. Police
nearby heard the gunshot and arrested Orlando Edmiston, 20. Officers
found a .38 caliber handgun beneath a parked van. (While ".38 caliber"
suggests a .38 Special, it could also be a less powerful .38 S&W or, in
newspaper talk, even a .380 ACP.)
