* Banning magazines holding more than 10 rounds; and
* Imposing a waiting period on handgun sales.
Biden also voted against the law that prohibits lawsuits designed to
bankrupt law-abiding firearm manufacturers and dealers. And he voted
against the confirmation of Supreme Court Justices who support the
Second Amendment, and voted for the confirmation of Justices who do not...

Et Tu, Democrats?: House Democrats make much of their support for the
right of the District to self-government. Too bad they are willing to
sacrifice this basic tenet of American democracy to the political
self-interests of members cowed by the powerful gun lobby. How else to
explain a planned vote on legislation so extreme it would strip the
District of all power to regulate guns? Since appeals for home rule
don't appear to be persuasive these days, let's hope that concern about
safety and security in the nation's capital kills this bad bill...
(Better to encourage DC's homegrown Democrats to defy the Supreme Court?
Not to mention that home rule for DC is a recent invention that runs
counter to the Constitution - see Article I, Section 8.)

Ohio CCW Law Changes: Concealed weapons permit holders can now keep a
gun hidden in a car, as long as they're carrying it in a secure holster
- one of several changes to Ohio's conceal carry law taking effect
Monday. The law previously required the gun to be in plain sight. Permit
holders also may bring a gun onto school grounds, as long as the gun
owner is in a car picking up or dropping off a child...Between 2004 and
2007, more than 108,000 people received carry licenses in Ohio. Last
year, the third full year of the law, Ohio sheriffs issued 22,103
licenses, an increase of nearly 18 percent from the previous year...

Ohio's Castle Doctrine to Take Effect: Ohio's version of the "Castle
Doctrine," which takes effect Tuesday, Sept. 9, will put a twist in the
idea that a person using force against an intruder in the home or car is
presumed to have acted in self-defense. Those who support concealed
carry laws say citizens will no longer have to go through a mental
checklist of rules that currently qualifies them for self-defense:
* That they didn't start the incident;
* That they attempted to flee;
* And that they believed they were in danger.
Those criteria will now be assumed... (I'm not sure that castle doctrine
implies an assumption that the defender attempted to flee - it usually
defines situations in which there is no requirement to attempt flight
before resorting to deadly force.)

What's Sauce for the Goose Is Sauce for the Gander: This morning, as you
are walking up the steps to your church, a squad of Allentown police
officers will besiege you, grab your Bible and tell you that some of the
beliefs of this church are adverse to good order. The officers say a
neighbor complained about you going to this church, but they won't
charge you with a crime and will return your Bible in a day or
two...Last Sunday, I discussed the case of an Allentown man whom police
went after because a neighbor told them he was armed. He had a license
to carry the gun and did nothing illegal, but the police stole the gun
(they call it ''seizure'') and did not return it until the following
day. The police justified their actions on the basis of a bogus 1962
city ordinance that says the Bill of Rights does not matter, nor does
the Pennsylvania Constitution, which says the right of citizens ''to
bear arms in defense of themselves ... shall not be questioned.'' The
police also defied a recent U.S. Supreme Court ruling that said they
cannot enforce gun controls that violate the Bill of Rights...

Speaking Out of Both Sides of Their Mouths: Did you know that more than
120 college presidents have signed on to an initiative that would lower
the drinking age to 18? As David Harsanyi of the Denver Post reports,
the presidents and chancellors are a part of the "Amethyst Initiative."
The website for the organization states that the 21-year-old drinking
age is not working, and, specifically, that it has created a culture of
dangerous binge drinking on their campuses. These college administrators
believe that adults should be treated like adults, which is refreshing
to hear considering so many college administrators are determined that
students and faculty be treated like children when it comes to
Right-to-Carry. Just as the heads of these colleges believe that
"moderation and responsibility" should be the standard for college
students when it comes to drinking, I believe that responsibility also
applies to those Right-to-Carry holders who happen to be college
students, professors or employees of a university...

New Jersey Women Reflect National Trend: It comes as no surprise, with
recent events and the increasing threats that women have to face in
everyday life, that a recent study released by the National Shooting
Sports Foundation (NSSF) shows that the number of women buying guns and
getting involved in the shooting sports (not only target shooting and
self defense, but hunting as well) has taken a dramatic increase in the

Oops, Wrong House, North Carolina Version: A gunman who broke into a
Fayetteville home Friday night was shot and killed by another man who
was inside the home at the time, police said. The gunman and an
accomplice forced their way into the house in the 6400 block of Winter
Park Drive about 10:50 p.m., said police Sgt. Sam Oates. An occupant of
the home grabbed a small-caliber handgun he kept in the house and fired
two shots at the pair as they hastily retreated. Police found the dead
assailant lying in the driveway of a nearby home. A gun was still in his
hand, Oates said... (Note that small-caliber handguns can eventually be
deadly but may not incapacitate quickly; by the same token, the same may
also be true with peripheral hits with larger calibers.)

Oops, Wrong House, California Version: A Vacaville resident shot and
killed a man who the resident said was burglarizing his home. The
resident, who police did not identify and who lives alone on the 1200
block of Balsam Way, awoke to the sound of voices inside his home around
2 a.m. Saturday, according to a press release from the Vacaville Police
Department. The resident armed himself with a handgun, confronted the
alleged burglar and shot him "at least once" in the torso, according to
police. The resident then called police. The Solano County Coroner has
not yet released the name of the deceased and police described him only
as an unidentified white male. Police found physical evidence at the
home that they believe shows a second person was in the home when the
shooting occurred. Police believe that person left the home through a
bedroom window...

Oops, Wrong House, Texas Version: A man breaks into a house, but the
homeowner is there and fights back with force. That homeowner shot and
killed the burglar on the Southeast Side near Westfall and South
Palmetto Street..."A homeowner woke up and found a burglar inside his
house. He had shot the burglar inside his house," explained Sgt. Steven
Peterson from San Antonio Police Department. Sgt. Peterson says the
suspected burglar was able to crawl back through a kitchen window after
being shot with a rifle. Officers found him in the backyard - already
dead and with no identification...

Oops, Wrong House, Missouri Version: A homeowner will likely not be
charged after shooting and wounding a suspected burglar, police said.
Officers said the man heard someone breaking a window at his home on
East 30th Street. He called police but shot the intruder twice before
officers arrived. The suspected burglar was hit in the arm and the side.
He ran out the back door, but police arrested him in the street in front
of the house.

Stupid Is as Stupid Does: A man whose hand was seriously injured the
first time he fired a revolver in the field is suing the weapon's
manufacturer, Smith & Wesson, in federal court in Texarkana. In
response, the gun manufacturer said there are no problems with the
design of the weapon, a 460 model revolver, and that the man caused the
accident by not heeding its warnings. The lawsuit, filed in July by Todd
and Kathy Brown of Rosston, alleges negligence by the gun manufacturer
is to blame for a Dec. 27, 2007, accident in which Todd Brown's left
thumb was severed... (I believe I recall this incident: Mr. Brown fired
a S&W .460 Magnum revolver using a thumbs-forward hold, that would be
appropriate for an autoloader. This placed his support-hand thumb
alongside the barrel-cylinder gap, where it was severed by escaping gas.)

Tangentially Related: Dick Cheney had Supreme Court nominees over to his
house for interviews. Al Gore kept weekly tabs on President Bill
Clinton's nominations to the federal bench. When it comes to picking
judges, vice presidents can matter. So the question is: How much
influence would Sen. Joseph Biden or Alaska Gov. Sarah Palin bring to
bear on the next administration's judicial nominations? Biden's
credentials as a former chairman of the Senate Judiciary Committee seem
to give him more clout in this area, while Palin - seen as the
conservative weight on the Republican ticket - is thought to be an
assurance that Sen. John McCain will make good on his promise to
nominate more judges in the mold of Chief Justice John Roberts Jr. and
Justice Samuel Alito Jr. In addition to the routine federal court
packing, the next administration could see as many as three vacancies on
the high court...
