Gura Remains Lead Counsel for Heller: ...Robert Levy, the Cato Institute
scholar who bankrolled the lawsuit against the strict D.C. handgun
ordinance, was unequivocal today. "Alan will be arguing this case," says
Levy. "He is a very bright guy, no one knows the issues better than he
does, he has been successful in the case thus far, and besides - it was
part of the deal." Levy explains that when he hired Gura at "subsistence
wages" to launch the lawsuit several years ago, the agreement was that
if the case advanced to the Supreme Court - no small feat in itself -
Gura would argue it. Levy has stood behind Gura before. But a fresh
round of rumors lately has reflected some anxiety in conservative
circles about leaving such a historic argument in the hands of a Supreme
Court novice. Theodore Olson of Gibson, Dunn & Crutcher is one name that

LEOSA Faces Challenge In New York Court: A 4-year-old federal gun law is
facing a test in Orange County Court, and a 33-year-old Coast Guard
officer from Newburgh is staking his future on the outcome...An officer
found an unlicensed, loaded semiautomatic handgun in Booth's car during
a routine search before impounding the car, according to a city police
report. An Orange County grand jury indicted Booth on a felony charge of
second-degree criminal possession of a weapon. Booth's lawyers have
filed court papers asking County Court Judge Robert Freehill to dismiss
the indictment.
Booth's lawyers argue that he falls under the Law Enforcement Officers
Safety Act of 2004...

Colorado Considers Rule-Five Legislation: In the wake of Columbine,
state lawmakers rejected a proposal requiring gun owners to safely store
their weapons to keep them out of the hands of children. Eight years
later, they're considering a scaled-down version that doesn't say how
people have to store their firearms but would still hold them
accountable if a child ends up bringing the gun to school or hurting or
killing someone. (Rule Five: Maintain control of your firearm. As it
says below, "Firearm safety - It's a matter for education, not
legislation.")

New York Newspaper Would Publish Names Of Pistol Permittees: The Glens
Falls Post-Star wants to know the names of all pistol permit holders in
Warren County and has submitted a Freedom of Information Law request to
the Warren County Clerk's Office to obtain a list of the concealed carry
permit holders, apparently with the intent to publish those names. This
request, apparently being undertaken by Post-Star reporter Nick Reisman,
has initiated a firestorm of protest from local law enforcement
officials, county officials, and certainly among gun owners and holders
of concealed carry permits...

The Pot Calling the Kettle Black?: Talk of guns and God set off a round
of campaign bickering between Barack Obama and Hillary Rodham Clinton
yesterday - after the Illinois senator at an Idaho rally said he'd been
"praising Jesus" for 20 years and had "no intention of taking away
folks' guns." Clinton accused him of flip-flopping, noting that in 1996
he'd been in support of a handgun ban.

Tangentially Related: ...We believe that the nomination of John McCain
is the best option to preserve the ongoing restoration of constitutional
government. He is by far the most electable Republican candidate
remaining in the race, and based on his record is as likely to appoint
judges committed to constitutionalism as Mitt Romney, a candidate for
whom we also have great respect...(So say a couple of law professors in
The Wall Street Journal. Personally, if McCain gets the GOP nomination,
I will probably read this opinion before I enter the polling booth in
November but I just can't bring myself to vote for him in tomorrow's
