John Lott On Giuliani's NRA Appearance: ...Possibly, Giuliani's opinions
on the Second Amendment were really affected by Judge Laurence
Silberman's recent court decision striking down Washington D.C.'s gun
ban. Silberman did make a persuasive case that the Second Amendment does
guarantee an individual right. But Giuliani has frequently pointed out
that constitutionally protected rights still allow "reasonable"
regulations to accomplish some other goal, such as public safety.
Despite the assurances of the press, Giuliani clearly did not say that
he would oppose new gun laws. Compared to what conservatives call the
"just about flawless performance" by Fred Thompson, Giuliani's
presentation just didn't cut it.

SAF Supports Oregon Teacher's Lawsuit: The Second Amendment Foundation
today announced that it is supporting a lawsuit filed by an Oregon high
school teacher against the Medford School District, in a case that could
have statewide, if not national implications. The teacher, identified as
"Jane Doe" to protect her privacy, is licensed to carry a concealed
firearm under Oregon state statute. She is fearful for her safety, and
that of her students, because of threats she has reportedly received
from her ex-husband, against whom she has a restraining order. School
officials are refusing to allow her to bring her gun on campus, despite
Oregon law which appears to allow it. Anti-gun State Sen. Ginny Burdick
(D-Portland) has vowed to introduce legislation that will exempt Oregon
public schools from the state's pre-emption law.

Senator Coburn vs. The NICS Improvement Act: "We've told the whole
Congress that we support it," said NRA chief Wayne LaPierre. "If you're
a law-abiding person, everything in there is an advancement over current
law." ...Sen. Tom Coburn, R-Okla., disagrees - and that's all it takes
to stop a bill in the Senate. His concern is that billions of dollars of
new spending in the bill is not paid for by cuts in other programs. And
he says the bill does not pay for appeals by veterans or other Americans
who feel they have been wrongly barred from buying a gun.

Parker Attorney Debates RKBA: "I don't think you need the Second
Amendment to understand properly the ability to keep a gun," said Neily
in his remarks, which opened the debate. "Your ability to own a
particular object comes down to whether or not the Court has established
ownership of that object to be a fundamental right on the one hand or a
non-fundamental right on the other. Guns are just objects, like any
other object." Neily was co-counsel for the plaintiffs in the recent
Parker v. District of Columbia case, which challenged the
constitutionality of Washington, D.C.'s gun laws. In a landmark decision
in favor of gun rights, the U.S. Court of Appeals for the D.C. Circuit
struck down the ban on handguns in the Parker ruling last March.

NYPD Commissioner Calls For Regulation Of Muzzleloaders: Police
Commissioner Raymond Kelly called for stricter statewide gun regulations
today after a troubled St. John's University student bought an antique
weapon upstate and carried it onto a Queens campus, prompting his
arrest..."Anything you can put a bullet in" should require a permit, Mr.
Kelly said at a midday news conference. He added: "I'm certainly a
proponent for more regulations."

New Jersey Man Charged In Airsoft Shooting: A man was arrested after
accidentally shooting his girlfriend in the thigh with a plastic BB gun
Sunday, police reports said. Pedro Dubon, 38, of the 200 block of Cliff
Street in Cliffside Park, was charged with aggravated assault and
unlawful possession of a weapon, reports said... "No one should be using
any kind of weapon indoors," West New York Police Director Oscar
Fernandez. "It might not kill someone but it could injure someone
seriously."

Virginia Grand Jury To Weigh Shooting Of Fleeing Robber: A Richmond
grand jury will decide whether the fatal shooting of an ice-cream parlor
armed robber was a justified act of self-defense or the reckless use of
a deadly weapon. On that decision rests the immediate future of David
Fielding, a 21-year-old art student at Virginia Commonwealth University
who was shift manager at the Forest Hill Avenue Baskin-Robbins store on
Sept. 6, the night of the robbery.

Oklahoma Man Charged In Road-Rage Shooting: There are new developments
in a case of road rage that ended with one man dead. The man who police
say shot and killed another driver at a Riverside Park last June turned
himself into police on Friday. He is charged with first-degree
manslaughter. The News On 6's Ashli Sims reports Kenneth Gumm is out on
bond, and his attorney, who specializes in gun rights, says this case is

Firearm Safety - It's A Matter For education, Not Gun Locks: ...But
because we can't legislate against childhood curiosity or enforce good
adult judgment, that mostly leaves education, awareness and a boat-load
of gun locks as the best defenses against tragedy and near-tragedy. That
parents refrain from combining guns in a house along with illegal drugs,
as is the allegation against the Bossier child's father, is a given. (To
most people, gun locks mean trigger locks and sticking something inside
the trigger guard is analogous to violating Rule Three, leaving your
finger inside the trigger guard when you are not prepared to fire.)
