Pilot Program - Repeal All Guns Laws For Five Years: John Longenecker is
back with a proposal - the repeal of all anti-gun laws - all 22,000 of
them -- for a period of five years. This includes a moratorium on all
new gun laws for five years, and suspension of all court cases pending
for weapons charges with the exception of violent crimes involving a
gun. Owning a certain rifle is considerably different from holding up a
liquor store with a gun.

Oops, Wrong House: A Texas homeowner fatally shot a man he encountered
after he returned home and found a strange car in the driveway and an
open door. The burglar allegedly reached for something in a bag, and
authorities say they later found two loaded weapons. (It's generally
wiser, in such a scenario, to call 911 and let police make the entry
into the home.)

Meanwhile, In Chicago...: A would-be robber was shot and killed by a man
he was trying to rob Thursday afternoon on Chicago's South Side, police
said... Neal and an accomplice tried to rob a 23-year-old man at
gunpoint as he entered his apartment with his 1-year-old son, Greer
said. The man produced a gun and fired at his attackers. (Miraculously,
no mention is made of firearm charges against the young father who
defended himself and his son.)

Romney Defends Timing Of NRA Membership: Romney said Sunday during an
interview on ABC's "This Week with George Stephanopoulos" that he'd
signed up for a lifetime membership with the NRA "within the last year."
Romney spokesman Kevin Madden told The Boston Globe the former
Massachusetts governor's joined the NRA in August, and that the decision
was not a ploy to attract conservative voters.

Tangentially Related: The Los Angeles Times  expresses concern that the
new composition of the Supreme Court may cast Justice Scalia as the
leader of a new conservative majority. (While the commentary makes no
mention of the RKBA, the concept could be the vehicle by which a

From JPFO: In 2003, Akins Group Inc. developed the Akins Accelerator, a
bumpfire stock for a Ruger 10/22 that can produce about 650
rounds/minute. The company received classification letters from the
BATFE agreeing that the stock was not a firearm and therefore
unregulated...True to form, the BATFE suddenly decided that the plastic
stock was in fact a machine gun. The considerable time, effort, and of
course money Akins invested into the project has been rendered
essentially useless...

On Monday, February 19, 2007, the House and Senate formally voted (Third
Read) on bills that passed out of Committee of the Whole (COW) on
February 15, 2007.  The House voted on HB 2469, and the Senate was
scheduled to vote on SB 1250 and SB 1302.  However SB 1302 was "held"
for a later date because the sponsor was not available.  Once a bill
passes Third Read, they "cross-over" to the other chamber and they're
half-way to the governor's desk.

The following is a summary of the Third Read:

HB 2469 - Passed 45-10 with 5 not voting.

Reduces the penalty for a concealed weapon permit holder failing to have
their permit in their possession while carrying concealed.

SB 1250 - Passed 27-2 (Impressive!) with 1 not voting.

Eliminates the fingerprint requirement for concealed carry permit renewals.

SB 1302 - Held over until the sponsor can be there.

Clarifies that the intent of the Castle Doctrine bill that restored
"innocent until proven guilty" applied to all court cases pending on
April 24, 2006 when the bill was signed.

gun owners are politically involved and care about the legislative
process.  They need to feel YOUR pressure.

We apologize for the lateness of this Alert.  We cannot predict when the
Senate will post their floor calendars and were able to catch this only
at the last moment.

On Thursday (sic), February 20, 2007, the Committee of the Whole (COW)
in the Senate will debate and vote on SB 1251, SB 1258 and SB 1301.

The following is a synopsis of these bills:

SB 1251 - Strengthens the "public establishment or event" storage
requirements:
�        Defines "secure storage" and "readily accessible."
�        Prohibits recording information about the weapon or individual.
�        If an "operator" doesn't comply, they can't prohibit weapons.

An amendment was passed in the Senate Judiciary committee removing a
proposed CCW permit holder exemption and making an exception "to a
public event where control of security has been transferred to the
United States Secret Service pursuant to 3 U.S.C. Sec. 202."

SB 1258 - Would prohibit the Governor or Adjutant General from
confiscating lawfully held firearms or ammunition during a state of
emergency.

SB 1301 - Rewrites 13-3102.F to clarify that if any portion of a weapon
or holster is visible, the weapon is openly carried.

Now comes YOUR part - Take the time to let EVERY Senator know that you
want them to vote FOR these bills, and that you are monitoring their
vote.  Following is a cut-and-paste message that you can use, or
personalize to your taste.  Following the letter, we've provided emails
lists of the Senate in semi-colon and comma separated formats.  Use the
one that works with your email software.


Subject:  Vote FOR SB 1251, SB 1258 and SB 1301

Dear Senator:

The Arizona Citizens Defense League (AzCDL) has informed me that the
Committee of the Whole (COW) will be hearing SB 1251, SB 1258 and SB
1301 on February 20, 2007.  I urge you to vote FOR the passage of these
important bills.

SB 1251 clarifies the "public establishment or event" storage
requirements passed last year.  Compliance by State agencies and
municipalities has been uneven.  Storage lockers have not been
available; unauthorized record keeping about individuals carrying
weapons has taken place; and operators of some public establishments
have refused to comply with the law.  Storage polices need to be uniform
throughout the State, and operators of public establishments need to
have clear guidelines in order to comply with the intent of the Legislature.

SB 1258 prevents confiscation of lawfully held firearms during a state
of emergency. I was horrified by the events that followed Hurricane
Katrina in New Orleans.  As violent criminals attacked citizens with
impunity, law enforcement abused a statutory provision that allowed the
government to "regulate" firearms during a state of emergency in order
to confiscate privately owned firearms.  They deprived law-abiding
citizens of their only means of defense against otherwise unrestrained
violence.  It is imperative that law-abiding citizens in Arizona do not
face similar abuse.

SB 1301 proposes corrections to ARS 13-3102.F regarding the permissible
carrying of weapons without a concealed weapons (CCW) permit.  Current
law allows a weapon to be carried visibly without a CCW permit only if
the weapon is worn in a belt holster.  Furthermore, the holster, not the
weapon must be visible.  The intent of the law is that a weapon must be
visible.  However, as currently stated, a very visible weapon may very
well get a person arrested for a concealed weapons violation.  That is
neither just, not was it the intent of the legislature when it enacted
the current language.

The proposed corrections to ARS 13-3102.F would assist law enforcement
officers in properly identifying legal instances of open carry by
recognizing that any portion of either the weapon or holster can be
visible.  Additionally, the language regarding carrying a weapon in a
case, scabbard or luggage is clarified.  These changes would also reduce
the erroneous "misconduct involving weapons" charges under ARS
13-3102.A.1 & 2, thereby reducing the burden on both law enforcement and
the law-abiding public.

Again, I urge you to vote FOR SB 1251, SB 1258 and SB 1301.
