Firearm Bills Pass New Mexico House Committee: ...HB 588 would amend the
state's concealed carry laws to allow a person with a concealed weapon
license to carry his gun into package stores, convenience stores and
grocery stores where alcohol is sold for consumption off the premises.
Right now, no guns are allowed in any liquor-selling establishment,
period. A castle-doctrine bill is pending.

Kansas Gun Owners Fight Weapon Bans: When Kansas began allowing
qualified citizens to carry concealed handguns, A.J. Conard posted a
sign at her business prohibiting them. When two members of a gun club
objected to the sign, she took it down. A small victory - Conard says
she had mistakenly thought the sign was required by law - but one that a
handful of Hutchinson area gun owners hope to duplicate at other stores
through boycotts. (I wonder where she got that idea.)

Convoluted Logic? A senior at Georgetown University argues for federal
legislation "to create a national standard for carrying concealed
firearms...The Constitution requires, then, that we properly protect
citizens' Second Amendment rights by allowing them to carry concealed
weapons across state lines." Among the problems with his logic,
requiring a license for CCW is not consistent with the Second Amendment.
(I don't trust people like Nancy Pelosi and Dianne Feinstein to set
national standards for CCW - the feds have means to impose federal
standards on the states by denying funding for various projects if the
states don't comply.)

Austria Denies Responsibility For Terrorist Use Of Steyr Rifles: Austria
yesterday washed its hands of any responsibility after it was revealed
that powerful sniper rifles it sold to Iran had been acquired by
insurgents in Iraq. The Daily Telegraph revealed yesterday that American
troops had recovered more than 100 Steyr HS50 Mannlicher rifles, part of
a consignment of 800 sold to Iran by Austria last year, during a series
of raids in Iraq. (Not clear from the article is whether the actual sale
was made by Steyr or by the government.)

ACTION ALERT! Pro-rights bills passing COW to be formally voted on by
the full House and Senate on 2/19/07!

On Monday, February 19, 2007, the House and Senate will formally vote
(Third Read) on bills that passed out of Committee of the Whole (COW) on
February 15, 2007. The House will decide on HB 2469, and the Senate will
decide on SB 1250 and SB 1302. This vote is the final, crucial vote in
their respective legislative chambers! Once they
pass Third Read, they "cross-over" to the other chamber and they're
half-way to the governor's desk.

The following is a synopsis of these bills:

HB 2469 reduces the penalty for a concealed weapon permit holder failing
to have their permit in their possession while carrying concealed. Under
current law (ARS 13-3112.D), a person is guilty of a class 2 misdemeanor
offense if they fail to present a concealed weapons permit upon the
request of a law enforcement officer. The language of the current law
does not clarify that a person must be a concealed weapons permit
holder, or in possession of a weapon, or even if a weapon must be
concealed. However, if they produce a legible permit that was valid at
the time of the violation when they go to court, "they shall not be
convicted."

The proposed language in HB 2469:
Restricts the application of the law to concealed weapons permit holders.
Reduces the penalty to a petty offense.
Retains the "shall not convict" language.
Clarifies that a permit holder can only be charged if they are
carrying a concealed weapon when they fail to present their permit at
the request of a law enforcement officer.

SB 1250 eliminates the fingerprint requirement for concealed carry
permit renewals.

SB 1302 clarifies that the intent of the Castle Doctrine bill that
restored "innocent until proven guilty" applied to all court cases
pending on April 24, 2006 when the bill was signed. Sadly, there was a
high-profile case pending at the time against a hiker who used a gun to
defend himself against an attack. The judge in the case did not allow
the case to be heard under the new law. The hiker was convicted of
murder under the old law where he had to first admit to shooting
someone, and then had to try to prove his innocence to a jury with the
prosecuting attorney controlling all the evidence.
