Judiciary Committee.  HB 2074 passed the committee today by a 4-3 vote.

You need to contact committee members today to ensure that the remaining
bills pass out of committee.  Below is a sample letter to cut-and-paste
into an email message.  Near the end of this message you will find the
email addresses and phone numbers of all the committee members.  Please
send EACH committee member an email or
letter urging them to pass these bills out of committee with a
recommendation for
passage by the full House.

Opponents of these bills are already working to defeat them.  If you
care about your freedom, you need to contact committee members immediately.

Dear Representative:

The Arizona Citizens Defense League (AzCDL) has informed me that the
following legislation is under consideration by your committee.  I urge
you to vote these bills out of committee with a recommendation for
passage by the full House:

HB 2075 - Requires the intent to commit a serious crime before a person
can be charged for carrying concealed without a permit.  Because of two
1994 Appellate Court decisions altering the meaning of A.R.S. Section
13-3102.F law-abiding citizens risk arrest for carrying a concealed
weapon in ordinary circumstances without any
criminal intent:

 Passengers (children and adults) risk arrest when traveling in a
vehicle containing a weapon.  This includes taxis, buses and other means
of conveyance (State v. Adams, 189 Ariz. 235, 941 P.2d).

 Law-abiding citizens without a concealed carry (CCW) permit, but
carrying a gun "openly" (not concealed), can be arrested if their gun is
not obvious to the arresting officer (State v. Moerman, 182 Ariz. 255,
895 P.2d 1018).

Court decisions have placed non-weapon carrying citizens at risk of
arrest for being in the proximity of a weapon and have all but
eliminated the right to carry openly unless the gun owner has a CCW
permit.  HB 2075 will restore the rights of the law-abiding while still
allowing law enforcement personnel to use permit-less concealed
carry as a tool to fight serious crime.  The vast majority of current
"misconduct" arrests involving concealed weapons under A.R.S. Section
13-3102.A.1 & 2 are secondary offenses.  HB 2075 will ensure that
Arizona is not wasting taxpayer money prosecuting otherwise innocent
individuals.

HB 2076 - Requires on-site, "readily accessible" storage and "immediate
retrieval" of a weapon when public establishments or events forbid
weapons.  Current law has no on-site storage requirement and compliant
gun owners have found they must travel to
inconvenient and remote locations to retrieve their property.

HB 2077 - Improves on the ability to obtain a CCW permit by allowing an
NRA 8 hour firearms class, or the possession of another state's CCW
permit recognized by Arizona, to serve as a substitute for the DPS
training course.  Again, Arizona is in a very exclusive minority of
states that do not allow any firearms training other than what a State
agency dictates.  The majority of the states issuing permits recognized
by Arizona allow NRA firearms courses to satisfy their training
requirements.  Some, like Florida, allow any NRA course to meet their
requirement.  Florida has issued over a Million permits since 1987 and
is considered the model for shall-issue CCW permit
states.

Arizona also allows millions of citizens from 30 other states to carry a
concealed weapon in Arizona if they have a current permit from their
home state.  However, if that person attempts to obtain an Arizona
permit, their prior training and qualifications become meaningless and
they must start all over.  This serves as another disincentive to obtain
an Arizona CCW permit.

Expanding training opportunities and allowing for prior recognized
training will facilitate more gun owners obtaining CCW permits.  After
the Arizona CCW training requirements were reduced from 16 hours to 8
hours in the 2005 legislative session, permit applications jumped by
approximately 4,000 in a 4 month period.  That meant more gun owners
became better trained and about 1/4 Million Dollars in State revenue was
generated.  Currently, only around 1% of Arizona citizens have CCW
permits; largely due to some of the most restrictive requirements in the
nation.  Isn't it better to have more educated, safety conscious gun owners?
