Tenants of senior-living complex sue over alleged bed bug infestation [1]

The owners of a large senior-living complex in Waterloo are facing a class-action lawsuit brought by tenants over an alleged, long-running bed bug infestation.
Theresa Allen, a current tenant of Walnut Court apartments, and Gary Montgomery, a former tenant of the complex, are suing 315 Walnut Co-Op and Larson Management, the two companies that own and manage the 91-unit apartment complex. They’re suing on behalf of themselves and all similarly situated individuals who have lived at the complex since the alleged infestation began in 2018.
The tenants claim that for the past five years Walnut Court has been the site of a “raging, unabated bed bug infestation” the defendants have attempted to address only through half-measures, allowing the insects to repeatedly migrate from one area of the complex to another.
The lawsuit claims that over the past five years, the owner and manager never informed prospective tenants of the infestation, leading to additional problems. Tenants have allegedly suffered bites, rashes, anxiety and parasitosis, and have had to discard household belongings such as clothing and bed linens.
The lawsuit seeks unspecified damages for consumer fraud, premises liability and breach of contract. It also seeks a court injunction ordering the remediation and eradication of the alleged infestation. The defendants in the case have denied any wrongdoing.
State records indicate 315 Walnut Co-Op and Larson Management are owned by David and Kendra Larson of Denver, Iowa. David Larson declined to comment on the case when contacted Thursday.
State and county real estate records indicate the Larsons also own and operate South Hills Senior Living and the Colonial Manor Apartments senior-living complex, both of which are located in Waterloo, as well as the Willow Winds Assisted Living Center, a state-licensed care facility in Denver, Iowa.
