Robin Tombs on LinkedIn: FTC Denies Application for New Parental Consent Mechanism Under COPPA

Yoti is a #privacytech & #safetytech business so we are naturally disappointed today to receive a letter from the Federal Trade Commission effectively postponing a decision on facial #ageestimation (FAE) until after the FTC is able to study National Institute of Standards and Technology (NIST) published independent results on the accuracy of vendor FAE models. Since January 2019, Yoti has regularly published its FAE performance by year of age (6-70), gender & skin tone, using large, (120,000 unique individuals) diverse test data, to help all interested parties understand this innovative new age checking method. Yoti has also published real world information showing that wherever adults anywhere in the world are offered a choice of age check methods which include FAE, a high majority choose to use Yoti FAE in preference to other methods. We do recognise it will be helpful to both the FTC and all other interested parties, including members of the public, to understand independent test results across years of age, gender & ethnic groups from a collection of vendors, before the FTC makes a very important decision whether to allow parents to choose to use facial age estimation to provide verified parental consent & businesses accept such evidence to comply with #COPPA. Yoti submitted its model to NIST in mid September 2023 and we understand NIST are scheduled to publish vendor results (based on test data of millions of unique individuals aged 12-70) on Wednesday 10 April at the Global Age Assurance Summit in Manchester, UK.
