Is Kidnapping No Longer a Felony in the State of New York? Just Asking for NYC's Comptroller.... [1]

So...the penalty in the State of New York for violating Penal Law § 135.20...is now a serious public tongue lashing by the Governor? Used to be up to 25 Years at Sing Sing….

IANAL….but these two (one masked) clowns sure look they have committed every element of Kidnapping in the Second Degree here in this picture taken by an AP photographer and distributed to newspapers and websites worldwide. Certainly there’s enough evidence for the NY Attorney General to—IDK—empanel a freaking grand jury? Help me out here, because I’m about 99.999% certain that no agent or officer of ICE has the power to arrest or detain ANY American citizens for ANY amount of time ANYWHERE IN THE FREAKING WORLD or any other planet known to man.



So, these alleged criminals are forcibly detaining a KNOWN American citizen. They lack the authority to do so for cause or for no cause. They can never ever ever ever in any place commit this action legally. Anywhere. And certainly not in a federal court house in the Great State(?) of New York. A clearer case of Kidnapping in the Second Degree has never existed. (ALLEGEDLY!!!)

Perhaps Attorney General James is overwhelmed investigating all the further crimes of the mob boss currently squatting in our Offal Office. So I’ll get her started. Here’s a blank charging document provided by the NY Courts:

KIDNAPPING IN THE SECOND DEGREE

Penal Law § 135.20

(Committed on or after Sept. 1, 1967)



Under our law, a person is guilty of Kidnapping in the

Second Degree when he or she abducts another person.

The following term used in that definition has a special

meaning:



ABDUCT means to restrain a person with intent to prevent

that person's liberation either by secreting or holding him or her

in a place where he or she is not likely to be found, or by using

or threatening to use deadly physical force. The following terms used in that definition of “abduct’ have

a special meaning: Restrain means to restrict a person's movements

intentionally and unlawfully in such manner as to interfere

substantially with his or her liberty by moving him or her from one

place to another, or by confining him or her either in the place

where the restriction commences or in a place to which he or she

has been moved, without consent and with knowledge that the

restriction is unlawful. A person restricts another's movements intentionally when

his or her conscious objective or purpose is to restrict that

person's movements. A person restricts another's movements unlawfully when he

or she is not authorized by law to do so.

Here’s the Governor’s response to this crime. No mention of charging the actual criminals. Just relieved Mr. Lander got to go home rather than getting sent to El Salvador.

I’m glad she’s putting in $50 million to help immigrants fight this bullshit. But how about bringing at least a butter knife to this machine gun fight and ENFORCE NEW YORK’S LAWS against KIDNAPPING??

Imagine the effect of just THESE TWO CLOWNS in the dock under indictment facing 25 YEARS. Think maybe some of the other foot soldiers might just rethink how they conduct themselves with everyone else????



Or yeah. Just be relieved he didn’t get dropped from a helicopter. This time.



I’m not asking for much. Just enforce the laws on the books y’all. At least make them show up in court and argue for some bullshit immunity. Under oath and all….
