"I am Senator Alex Padilla". Update: 'Whoever assaults any person designated in subsection...' [1]

FYI, according to the video footage, Padilla entered the room and stated, "I am Senator Alex Padilla", before attempting to ask Homeland Security Secretary Kristi Noem a question.

That is...kinda really important.

As we speak, the right wingers over at FOX are convincing themselves that roughing up a US Senator was just fine and dandy because Padilla did not identify himself and bum rushed Noem. It is, of course, a lie.

But that never stops them, now does it.

So, just so it’s crystal clear, send the following video around to everyone you know. It shows that Padilla stated, "I am Senator Alex Padilla", before attempting to ask Homeland Security Secretary Kristi Noem a question.

A salient comment:

The sequence is chilling. 1. Noem states her intent to use federal forces to "liberate" the city from its elected representatives. 2. Senator Padilla seeks to ask a question. 3. Plain clothes goons force Padilla out of the room where FBI agents throw him to the ground and handcuff him. Padilla clearly told them he was United States Senator, it did no good. #1 alone should be a major scandal. Noem stated that Homeland Security agents were staying to "liberate the city of socialist and the burdensome leadership that this governor and that this mayor have placed on this country."

Something tells me Padilla ended all that today. Thank you Sen. Padilla.

Senator Padilla needs to have the goons arrested for violating 18 U.S. Code § 351 - Congressional, Cabinet, and Supreme Court assassination, kidnapping, and assault https://www.law.cornell.edu/uscode/text/18/351

Here is the statue, in relevant parts:

(a) Whoever kills any individual who is a Member of Congress or a Member-of-Congress-elect,

(e ) Whoever assaults any person designated in subsection (a) [see above] of this section shall be fined under this title, or imprisoned not more than one year, or both; and if the assault involved the use of a dangerous weapon, or personal injury results, shall be fined under this title, or imprisoned not more than ten years, or both [emphasis added].

Check. Padilla is a Member of Congress.

Courts often refer to common law definitions of assault, which generally include attempts or threats of violence that create a reasonable apprehension of harm. Check.

(h) In a prosecution for an offense under this section the Government need not prove that the defendant knew that the victim of the offense was an individual protected by this section.

Check.
