Michael Popok, of Legal AF, finds an overlooked “disclosure” in the Trump Administration’s recent Discovery Filing:
“State Dept has engaged diplomatic discussions with El Salvador regarding Abrego Garcia.”
Did the Trump Administration just blink in its fight with the US Supreme Court and shaken by Saturday’s 1 am order, the public reaction to their juvenile social media taunting, and a scathing critique by a revered Republican Judge [J. Harvie Wilkinson], reverse course and working now to seek Abrego Garcia’s release from an El Salvadoran prison? Michael Popok looks closely at a new Trump Administration revelation buried in a discovery response that indicates that they may be working to bring Abrego Garcia home. [Michael Popok explains in the YouTube clip below.]
Popok goes onto explain this disclosure, and how it likely indicates a behind-the-scenes course change, in the Administration’s approach to this pivotal case. The headline generator, concerning their callous attacks on our most basic civil right — that of Due Process:

Further, Popok thinks that it was this Conservative Judge’s scathing rebuke that was the likely “wake up call,” that made them realize their executive trampling of Due Process (and Supreme Court’s ruling) was not going to work in the long run:
“Due process is the foundation of our Constitutional Order.” Timemark [5:30]
According to Popok, the conservative credentials of Fourth Circuit Judge J. Harvie Wilkinson are unassailable. A “liberal activist” Judge — he is not! Here’s a bit more from Wilkinson’s ruling against Trump Admin’s treatment of Garcia:
“Facilitation” does not permit the admittedly erroneous deportation of an individual to the one country’s prisons that the withholding order forbids and, further, to do so in disregard of a court order that the government not so subtly spurns. “Facilitation” does not sanction the abrogation of habeas corpus through the transfer of custody to foreign detention centers in the manner attempted here. Allowing all this would “facilitate” foreign detention more than it would domestic return. It would reduce the rule of law to lawlessness and tarnish the very values for which Americans of diverse views and persuasions have always stood.

Popok thinks it was this no nonsense rebuke that gave Trump advisors the kind of ‘empty shelves’ messaging crowbar they needed, to convince Trump it was time to change course on Abrego Garcia. … Quietly behind the scenes, of course; buried on page-whatever of their foot-dragging Discovery Filings.
Let’s hope that Popok is right. We shall see.
Let’s continue to resist too — and stand up to the Bully. So that his own incompetence and cruelty — when exposed to world — compels him to back down. Again, and again, and again.
