Two Judges Threaten to Hold Trump Admin in Contempt of Court [1]

Judges do not like to impose contempt citations. They will go to great lengths to give attorneys, witnesses, parties a chance to correct themselves rather than impose judicial civility by force. But sometimes they have no choice.

The Trump administration is leaving Judge Boasberg no choice, and he is going with that.

A federal judge threatened to open a contempt inquiry into the Trump administration over what he called its “willful disregard” for his order temporarily halting deportations under an obscure wartime law, which the White House invoked against individuals it accused of being gang members. The judge said in a 46-page opinion that there was “probable cause” to find the administration in contempt for its actions.

“The Constitution does not tolerate willful disobedience of judicial orders — especially by officials of a coordinate branch who have sworn an oath to uphold it,” the judge said in a written ruling. Allowing political leaders to defy court judgments would make “a solemn mockery” of “the constitution itself,” he said. . . . Boasberg moved forward with the contempt proceedings, saying the Trump administration’s actions on March 15 and 16, as the removal flights proceeded despite his order to the contrary, “demonstrate a willful disregard … sufficient for the Court to conclude that probable cause exists to find the Government in criminal contempt.”

Not just contempt; criminal contempt.

Judge Xinis, in the Kilmer Abreggo Garcia case, hasn’t gone that far yet, but she’s heading in that direction:

Xinis refrained from directing any particular action by the federal government and wanted to proceed with discovery to determine whether the government had complied with her order directing some kind of facilitation. She also indicated she was considering contempt for the administration and that she wanted more information on whether it was acting in bad faith in response to her order.

Yes, it’s taking time. Judges do that so as to make sure they have covered every angle; they don’t like being reversed by a higher court.

The is Constitutional crisis time. And the courts (so far) are not backing down from the fight.
