✂️ The five male justices have issued a glib, “four-paragraph per curiam opinion discarding the District Court’s order based solely on a new legal pronouncement that, one might have thought, would require significant deliberation,” as Justice Jackson so eloquently dissented. She also points out that “[s]urely, the question whether such Government action is consistent with our Constitution and laws warrants considerable thought and attention from the Judiciary.” This is a common theme in Justice Sotomayor’s dissent as well, with whom Justices Kagan and Jackson join, and with whom Justice Barrett joins in part: Critically, even the majority today agrees, and the Federal Government now admits, that individuals subject to removal under the Alien Enemies Act are entitled to adequate notice and judicial review before they can be removed. That should have been the end of the matter. Yet, with “barebones briefing, no argument, and scarce time for reflection,” the Court announces that legal challenges to an individual’s removal under the Alien Enemies Act must be brought in habeas petitions in the district where they are detained. The Court’s legal conclusion is suspect. The Court intervenes anyway, granting the Government extraordinary relief and vacating the District Court’s order on that basis alone. It does so without mention of the grave harm Plaintiffs will face if they are erroneously removed to El Salvador or regard for the Government’s attempts to subvert the judicial process throughout this litigation. Because the Court should not reward the Government’s efforts to erode the rule of law with discretionary equitable relief, I respectfully dissent.

The mother and children detained by immigration authorities about two weeks ago in the small New York village where President Donald Trump's "border czar," Tom Homan, lives were released Monday. Jennifer Gaffney, superintendent of the Sackets Harbor Central School District, where the children are students, had been leading efforts to ensure the family's release since they were detained on March 27 and sent to the Karnes County Detention Facility in Texas. "After eleven days of uncertainty, our students and their mother are returning home," Gaffney said in a statement Monday. "We remain committed to providing the care, understanding, and sensitivity necessary for all students and staff as we begin the healing process from this traumatic experience." A senior official in the Department of Homeland Security confirmed to NBC News that the family is set to return home. New York Gov. Kathy Hochul said in a statement Monday afternoon that she spoke with Homan, who confirmed to her that the family is "currently on their way back" to Sackets Harbor in Jefferson County. "I cannot imagine the trauma these kids and their mom are feeling, and I pray they will be able to heal when they return home," Hochul said.

The MTA and the Trump administration have reached an agreement that could keep New York City congestion pricing in place into the fall. After pulling authorization of the program just weeks after it was launched, the federal government initially insisted on a March 21 deadline for the MTA to shut the cameras off. That line in the sand was eventually pushed back 30 days. However, it has since been revealed in a court filing that both parties have agreed to hold off on the April 20 deadline until at least October. The proposed timeline would give both sides time to finalize their motions to the judge, who will then have the final say on the future of the controversial tolling program. The Trump administration and the judge have yet to respond to the court filing. The state has remained defiant all along, saying the program will continue to move forward.

OVER THE LAST WEEK, amid government turmoil, massive new tariffs, a stock market free-fall beckoning a possible recession, and other major news, many Americans likely missed a story that was unfolding in the normally quiet forests of Lithuania. Four U.S. soldiers, including three seasoned and professional non-commissioned officers, tragically lost their lives when their M88 Hercules recovery vehicle was swallowed by a hidden sinkhole during a training mission. The remains of Staff Sgt. Jose Duenez Jr., Staff Sgt. Edvin F. Franco, PFC Dante D. Taitano, and Staff Sgt. Troy S. Knutson-Collins were recovered after an exhaustive eight-day operation that showcased not only the unwavering commitment of American forces to their fellow soldiers, but also the profound solidarity of our allies in Europe. As a former tanker who spent much of a long career in Europe, I know the training ground at the Pabradė Training Area. I used to command the 1st Armored Division, the unit to which the four fallen soldiers were attached for the exercises in Lithuania, and I know and admire the current commander, Maj. Gen. Curtis Taylor. So my ears perked up when I first heard the report of missing soldiers. Having faced similar crises, I know the anxiety and urgency that faces any commander when soldiers go missing. The Army is always parsimonious with the details it gives to the media, so much of the story of the search and eventual recovery of those four soldiers’ remains and their vehicle hasn’t been told. But the details of those eight days that I’ve heard from soldiers involved in the operations is a testament to the seven Army values. The story also highlights the loyalty of our allies, which I came to know so well when commanding U.S. Army Europe. As the nature of our alliances changes, and many Americans seem to be questioning the value of having friends abroad at all, it’s a story worth hearing.
