4th Circuit Upholds Order to Return Abrego Garcia [1]

A unanimous three-judge panel of the 4th Circuit Court of Appeals has upheld District Court Judge Xinis’s order that the Trump Administration must return Kilmar Armando Abrego Garcia to the United States from El Salvador. The order came in the form of a denial of the Administrations request of the district court’s order pending appeal.
Judge Wilkinson, who is one of the most conservative Appeals Court judges, concurred. However, he upheld the authority of the district court only to order the Administration to “facilitate”—rather that require—Abrego Garcia’s repatriation.
The Trump DOJ didn’t even wait for the 4th Circuit’s order before running to the Supreme Court.
