The Hill newspaper reports that President Trump has been sued by a small stationary store called Simplified in Pensacola, Florida that sources its product from China. The exorbitant tariffs on China threaten to shutter the store. One might ask why should such a small case of economic ruination garner any media attention when thousands of workers at auto plants are being laid off as a result of the punitive tariffs? Zach Schonfeld of the Hill writes:

“The lawsuit contests Trump’s use of the International Emergency Economic Powers Act of 1977 (IEEPA), arguing the law authorizes asset freezes and similar economic sanctions, but not tariffs.

“Congress passed the IEEPA to counter external emergencies, not to grant presidents a blank check to write domestic economic policy,” the lawsuit states.

The suit was brought by the New Civil Liberties Alliance (NCLA), a conservative legal advocacy group.” To wit: thehill.com/...

From a legal perspective, this is the first suit filed in Federal Court against the Executive for justifying its punitive tariff policy on a Statute that bestows no such power. It is evident that the President’s latest power grab is rubbing even Conservatives the wrong way. His pigheaded policies have impeded the flow of capital—anathema to those who embrace the underlying principles of free trade. Folks, the tariff disaster triggered by this regime presents us with a unique opportunity to forge alliances with classical Republicans to resist Trump’s assault on our international trading partners, our livelihoods and retirement accounts. The bipartisan resolution in the Senate co-sponsored by Tim Kaine and Rand Paul condemning tariffs against our ally, Canada, that was passed yesterday attests to the potentials that exist. Senators Cantwell and Grassley are also introducing a bill that would “expand Congressional authority by requiring the President to secure Congressional approval for tariffs within 60 days or the tariff would expire.” Read about it here: www.pbs.org/... I urge all concerned citizens to write their Representatives and Senators to pass this bill as a matter of national security. The President’s indiscriminate, economic assault on our nation and indeed the world must be halted. Congress must fulfill its constitutional role and check the extra-judicial actions of the Executive. We can remind them to do just that.
