The story didn't end with the University of Maine's capitulation to Trump's demand to keep trans out if women's sports. The University was actually just complying to the NCAA's rule changes.
But there was the still the controversy about the Greely High School trans athlete who won the pole vault back in February. Gov. Mills decided to follow Maine's law.
The last time Trump and Mill's clashed was with Trump's Truth Social post from March 22nd, where Trump demanded "a full- throated apology." She didn't give him one.
Last week the Department of Health and Human Services found Maine in non-compliance with Title IX by denying female "student athletes an equal opportunity to participate without heightened safety and competitive concerns."
Trump threatened to withhold school funding for Maine's defiance of his executive order, but she says Trump can't cut funding.
"This is about the rule of law. It's about who makes the laws which is the legislature and the Congress and who enforces it and executes the laws, which is the executive, it's as simple as that," Gov. Mills said to a local TV station.
Mills says that complying with Trump's orders would break both federal and state laws, which recognize trans students and prohibit discrimination against them. We're just talking about grade school and high school athletes now.
The high school trans athlete became part of the controversy after a Maine state representative, Laurel Libby, posted photos of the athlete and claimed on national media that trans should be banned from girl's sports. Libby was censured by by the Maine legislature, and has since filed a lawsuit to have it overturned.
The Maine Principals' Association said that they were "bound by law, including the Maine Human Rights Act, which our participation policy reflects."
Maine was given till March 27th to comply, and so the HHS Office of Civil Rights found Maine in violation of Title IX on March 28th.
Referring the matter to the Justice Department for a civil rights violation. It's amazing how the aspirational process of civil rights has been turned into a weapon to do the opposite. The right keeps getting away with it, causing court cases to have to right an obvious wrong. Just like DEI is automatically a violation of civil rights, trans existence is a threat to their straight white world.
All because of Trump's "Keeping Men Out of Women's Sports" executive order. The problem is that everyone is taking Trump's executive orders as if they were law, when they're not. By treating them as if they were law, Congress is giving up its power to legislate as well as the power of the purse. When Trump has got every agency under his control, this is what happens. Instant law. No debate necessary.
Maine Administrative School District 51, where Greeley High School is located, said in their statement, "To our students: Thank you for your maturity, perseverance and dedication to learning through these distractions. Please continue to lead the way."
Trump is never going to get his "full-throated apology" from Gov. Mills. She predicted it at the governor's conference: "I'll see you in court!"
It's time for Trump's instant law making to be challenged along with the misuse of Title IX.
The US District Court of Maine is headed up by Chief Justice Lance Edward Walker, appointed by Trump after being recommended by Sen. Susan Collins and Sen. Angus King. This should be the venue of the case. On his Senate Judiciary questionnaire in 2018, he reported being a member of the Federalist Society, the NRA, but also the Audubon Society. He last major ruling was in favor of Maine's ranked choice voting system, so it may be a good venue after all.
Stay tuned for the next episode of Gov. Mills v. Trump. The question is who files a lawsuit first? Gov. Mills for a real civil rights violation, or a fake one by the Dept. of Justice.
We'll see very shortly.
