Is the Insurrection Act coming [1]

['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.']

Does this fulfill the J6 promise by threatening a migrant invasion and provide the means to enact martial law? Does this latest proclamation provide the false premise for an incursion somewhere South like Venezuela, because regime change?

Trump signed an Executive Order on 1/20 requiring that within 3 months he receive a report from Kristi Noem and Pete Hegseth on whether to invoke the Insurrection Act.

One of President Donald Trump’s first executive orders mentions the potential use of the Insurrection Act of 1807 to carry out his immigration policies.

The act allows presidents to call on the military to respond to unrest within the states.

Legal experts warned Trump’s ability to bend institutions to suit his goals could lead to a military being used as a domestic police force.

Many of us are now holding our collective breath, knowing that the report and what it contains could put us on the slippery slope toward unchecked presidential power under a man with an affinity for ironfisted dictators. Adding to the suspense was the recent “Friday Night Massacre” at the Pentagon — the firing of the nation’s top uniformed officer and removing other perceived guardrails (i.e., the top uniformed lawyers at the Army, Navy and Air Force) standing between the president and his long-stated intention to declare martial law upon returning to power. www.sfchronicle.com/...

Trump declared a national emergency at the southern border

x Number of migrants apprehended by US Border Patrol at the border with Canada dropped to the lowest point since 2022 last month, according to U.S. Customs and Border Protection statistics published on Thursday. - 481 people in February

- 616 in January

- 3,601 in June, which was a multi-year high — Olga Nesterova (@onestpress.bsky.social) March 13, 2025 at 6:37 PM

This proclamation allows Trump to access federal funding for border wall construction and to deploy U.S. military personnel without congressional approval. Trump also declared an emergency at the border during his first term. But this time, the language is far more sweeping, calling for military deployment to stem what the order describes as an invasion by “cartels, criminal gangs, known terrorists, human traffickers, smugglers, unvetted military-age males from foreign adversaries, and illicit narcotics.” In a separate but related proclamation, Trump ordered the armed forces to seal the borders and maintain the sovereignty and security of the United States. As of earlier Thursday, as many as 1,500 active duty troops were being dispatched to the region. What those troops are ultimately tasked with is theoretically limited by the 1870s Posse Comitatus Act, which generally limits the use of regular federal troops for domestic policing purposes, including enforcing immigration law. Some legal experts have worried, however, that Trump might invoke the 1807 Insurrection Act to get around these safeguards. While Trump hasn’t invoked the Insurrection Act as of this week, the “border emergency” executive order commands the secretaries of defense and homeland security to submit a report to the president on whether or not to use it. www.themarshallproject.org/…

Trump Invokes 1798 Wartime Law that Paved the Way for Japanese Internment. The legal authority for the roundup & imprisonment of 120K people of Japanese ancestry was an executive order, not the 1798 law.
