Hi there! First ever post, been lurking since the Bush "Administration" but never had a thing to say that I thought was worth a diary. Boy, I do now.
Listen, Executive Orders aren't really laws and you don't have to follow them if they conflict with actual laws. Federal regulations are different, and actually guide what Federal agencies, grantees and delegates can do. So as agencies start to issue regs to make the Executive Orders actual policy, shit gets real.
The State Department has issued what's known as a "Notice of Federal Rule-Making." In this case, state wants to modify the application for a US Passport:
To comply with E.O. 14168, “ Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,” the Department updated the form to replace the term “gender” with “sex.” The U.S. Passport conforms with the standards set by the E.O. and the International Civil Aviation Organization, which among other things determine the various fields on the passport's biographical data page. Consistent with the E.O., the revised DS-11 will request the applicant's biological sex at birth, male “M” or female “F.” Amendments to the fields and instructions (section 3) have been made to reflect this.
This is, to coin a phrase, bullshit. How are we to document "the applicant's biological sex at birth?" If someone has gone through the legal process to change their birth certificate to reflect their current gender identity (not actually that difficult btw), on what basis is State supposed to reject that document and issue a Passport that contradicts it? This rule is nonsense, determining someone's gender or sex is not the purview of the Federal Government, it's up to the states and functionally county governments who issuestate IDs and birth certificates, respectively.
I'm sure you all can come up with other reasons to object to this rule, and the thing is, issuing new Federal regs involves a period of public comment, and they have to respond to every comment. As of now, there are only 11,000 comments or so. Pathetic, let's aim for half a million.
So my humble request to the Daily Kos community is, tell 'em how you really feel. You, too, can comment on this inane, fascistic and asinine proposed rule, HERE.
And you get to do that every time they try to turn one of these idiot executive orders into an actual regulation. As, I'm not even kidding, part of the "Paperwork Reduction Act." The opposite of "Flood the zone with shit" is "flood the zone with reasonable (and otherwise) objections to stupid policy". So, please comment about the merits of having the Post Office - I don't know, pull down everybody's pants when they apply for a Passport? Because I don't actually know how they're supposed to implement this rule. Call the midwife (OBGYN)? It was the 70s, man, that dude's dead by now. Anyway, please comment on this proposed rule. Thanks, All!
