One Democratic victory: anti-trans-in-sports bill stymied in Senate [1]

Showing what determined Democrats even in the minority can do, a roll-call vote of the full U.S. Senate late yesterday denied, by a vote of 45-51, cloture to Bill S.8, the so-called, "Protection of Women and Girls in Sports Act of 2025." S.8 proposed that

1(d) (1) It shall be a violation of subsection (a) [of the Education Amendments of 1972] for a recipient of Federal funds who operates, sponsors, or facilitates athletic programs or activities to permit a person whose sex is male to participate in an athletic program or activity that is designated for women or girls. “(2) For purposes of this subsection, sex shall be recognized based solely on a person's reproductive biology and genetics at birth.

Cloture, a proceedure designed to end a filibuster and force a final vote on a proposed measure, currently requires 60 Yeas.

The party-line denial effectively shortstopped the measure, a version of which previously passed the full House on Jan. 14.

Four Senators were recorded as "not voting" on cloture: Republicans Capito, R-WV; Lummis, R-WY; and Democrats Slotkin D-Mi; and Welch D-VT.

LGBTQ Nation reported:

While the bill defines sex as “based solely on a person’s reproductive biology and genetics at birth,” the Congressional Equality Caucus noted that the bill “could force any student to answer invasive personal questions about their bodies & face humiliating physical inspections to ‘prove’ that they’re a girl.” The Democratic caucus referred to the bill as the “Child Predator Empowerment Act” and pointed out that the bill does nothing to address the sexism, unequal funding, and physical/sexual abuse that actually harms girls’ and women’s sports.

The publication also noted that Donlad Tump could still try to "pressure schools to abandon their own trans-inclusive sports policies," relying on his his earlier solo executive edict, without the authorization of Congress.

"Pressure," however--I think--unreinforced by legislation, may be at least possible for some schools to resist via legal action or simple refusal, allowing a little potential breathing room for trans youth and their parents.

Good on the Democrats.
