A Rundown of the Lawsuits Against Trump's Constitutional Travesties, Including Donation Links [1]

The battle for the salvation of our US democracy is currently being waged in courts across the country. One way we, as regular citizens, can help in this aspect of the struggle is to donate to organizations (where appropriate) who are taking this fight to the Trump cabal.

Below is a list of worthy orgs that are fighting on the many and various legal fronts with respect to Trump & Co’s hostile, illegal takeover, in some cases via actual outside-government actors, of the entire US federal system. But first I’d like to share an Emptywheel post by Marcy Wheeler about a recent such action that quickly bore fruit, a solid punch that had the desired effect:

It was that analysis by Marcy that got me thinking about how critical the legal portion of our fight will be. Here’s what we have to keep in mind: the federal judiciary consists of over 800 Active Judges, and the conservative/liberal breakdown of that group is roughly 50/50, but the MAGA portion of it is only about 30-40%. Furthermore, given the catastrophic nature of Trump’s first 2.5 weeks in office, it could be that the “leaners” on the Supreme Court may lean the other direction when the first of these cases get appealed to them.

Is it possible that Trump will just ignore rulings he doesn’t like? Yes, but that’s another bridge that we’re not in front of yet. Ok, so here’s the rundown:

1) Democracy 2025, https://www.democracy2025.org/about is the umbrella group that is the most wide-reaching, and which was part of the suit that stopped the OMB from illegaly defunding liberal grant-recipients.

2) Democracy Forward, https://democracyforward.org/ is focused on the legal front in the current battle, also involved in the OMB lawsuit. If you scroll down that page, you’ll see some the most recent cases they’re fighting. It’s worthy, critically necessary stuff.

3) GLAD, https://www.glad.org/ is one of the orgs that jumped on a trans lady prisoner’s EO-ordered transfer from a female to male detention facility; the transfer was halted (but not yet reversed). 4) NCLR, https://www.nclrights.org/about-us/ participated in that same case with GLAD.

5) Lambda Legal, https://lambdalegal.org/newsroom/us_20250127_ll-and-hrc-pledge-quick-action-against-trump-administration-renewed-transgender-military-service-ban/ is also fighting on the gender discrimination front, but in a broad-range filing that targets military rules, but doesn’t focus on a particular case.

6) A group of Quakers have sued to stop ICE, et al, from entering houses of worship to nab migrants. 7) WA, AZ, IL, and OR filed the suit that stopped (for now) Trump’s attempt to summarily overturn the birthright citizenship component of the 14th amendment. There are private actors among those plaintiffs also filing suits (they are listed at the top of the Just Security Litigation Tracker linked above), but those state AGs are doing the heavy lifting in those cases, but there is one birthright case involving Asian Pacific Americans that is supported by Washington Lawyers Committee, and Asian Americans Advancing Justice, both of whom take donations. There’s another for-hire practice involved, and it’s likely those two nonprofits will be footing that bill. That bill is interesting in that a Trump appointed judge will be hearing it. We’ll see how that pans out, but the courthouse pictured at the top of this diary is where it’s likely to end up.

8) A NY immigrants rights group, Make the Road NY, filed suit against the Trump Admin’s wholesale migrant roundups that skirt due process, https://www.reuters.com/legal/immigrant-group-sues-block-trumps-fast-track-deportations-2025-01-22/ The ACLU is doing the legal work for that NY org, so that’s where donations should go for that fight. https://www.aclu.org/ They’re likely to become involved in several more of these kinds of suits going forward: https://www.aclu.org/news/civil-liberties/the-aclu-is-fighting-back-against-trump.

9) Some Chicago Immigrants rights groups have sued to prevent Trump’s troops from targeting sanctuary cities, on that basis alone, https://www.cbsnews.com/chicago/news/immigrant-rights-groups-lawsuit-mass-deportations-president-trump/ These are small outfits, and they’re listed in the second paragraph of that article. That suit might have legs because it focuses on the difference between how ICE is dealing with Illinois versus TX an FL which have 3 times the immigrants as IL but aren’t sanctuary states. I don’t have links for those orgs but you can chase them down if you want to. One of the legal teams in that suit, Just Futures Law, is a non-profit where donations are appropriate.

10) There are several lawsuits against the actions and existence of DOGE. There’s another one that’s suing Treasury over DOGE, https://www.newsweek.com/us-treasury-sued-over-doges-access-sensitive-information-2025590 , brought by two AFL CIO unions and the Alliance for Retired Americans, https://retiredamericans.org/

11) There are a couple of lawsuits being brought by FBI agents who are being targeted by Trump for just doing their jobs investigating both the J6 insurrection and the Mar-a-Lago stolen classified documents case. One of those suits is being handled by Center for Employment Justice, which is a firm for hire, so donations aren’t applicable. The other case, however, is being partly handled by State Democracy Defenders which was founded by Norm Eisen (Jen Rubin’s “Contrarian” podcast-mate). It’s a non-partisan group with contributing actors ranging from MoveOn to PNAC, but they’re definitely anti-Trump.

NB: I did most of the research above on my own after an activist group I’m involved in asked me last week to suggest ways to support the various legal challenges to Trump’s “retribution rampage” currently underway. After having compiled the list for that group, I found out that Just Security has made a more comprehensive list: www.justsecurity.org/… There were a few lawsuits I hadn’t noticed that they included and I’ve added them below, but most of them are privately funded, so donation links are not applicable. There may also be other suits I’ve missed.
