It’s clear that Trump and his minions will treat the Judicial Branch just as they have treated Congress—cooperate when convenient, ignore or attack otherwise. Already today, reports indicate that various grant recipients remain unable to access funds awarded through an online portal, despite Judge AliKhan’s order delaying Trump’s freeze.
Andrew Jackson famously (and likely apocryphally) is said to have remarked about the Supreme Court: “John Marshall has made his decision; now let him enforce it!” The case in question affirmed the federal government’s constitutional authority to limit Georgia’s actions against the Cherokee Nation. By refusing to enforce the ruling, Jackson effectively allowed Georgia to impose its own laws, suspending Cherokee rights under the Constitution.
Looking ahead, I fully expect some state governments to exploit this precedent, accelerating their transformation into strongholds of Christian Nationalism. This is not only a dire threat to anyone who does not conform to their ideology but also a stark reminder of why Democrats must stand firmly with those who will inevitably face ruthless persecution.
