Distributed Power Kicks In [1]

The American system was set up not to allow unlimited power anywhere---and that includes the Presidency. Yes, Congress has ceded much of its power to the President, especially during the last 85 years. When we talk about the Balance of Powers, as it’s taught in schools, that aspect of it has become unbalanced.

Yet the formal Balance of Powers between the three branches of the Federal Government is just the tip of the American iceberg. The most consequential distribution of power is not between the branches of the central government, but between that government and the governments of the states, and between all of those governments and individual citizens. That’s what’s meant by distributed power.

So Donald Trump “took power” and decided to exercise it immediately, by throwing rocks in all directions and trying to destroy everything before anyone could react effectively. He had a week---or almost a week. And he failed. You only have to look at so many stories here on Kos today to see that. Defiance by governors. Lawsuits. Judges executing stays. He’s going to fight back, and sometimes he’ll win, though usually only temporarily. Distributed power will increasingly constrain him.

Project 2025 depended on the unlimited power of the presidency; it depended on an illusion.
