LGTBQ+ Folks Under Fire: Weekly Newsletter (Jan. 19, 2025) [1]

['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.']

Date: 2025-01-19

Tomorrow, it begins in earnest. So, this afternoon, I am starting a weekly newsletter which will capture some very top-line items for the week(s) to come. I have borrowed from a skeet from @prisonculture.bsky.social for the framework. All credit to them for the inspiration.

Items Adopted This* Week

We are in the early weeks of this Congress and most state legislatures, so the coffers are full of proposed legislation. Unfortunately, there have been the following provisions adopted in recent weeks:

US Congress : HR 28, the transgender athlete sports ban, passed the House on January 14 and has been sent to the Senate. A related bill, S. 9, is pending a third reading on the Senate floor. HR 5009, prohibiting coverage under TriCare for ‘medical interventions for the treatment of gender dysphoria that could result in sterilization…to a child under the age of 18’. It was signed into law on December 23, 2024.

Ohio HB 08: “Parents’ Bill of Rights”, includes ‘gender ideology’ in the definition of ‘sexuality content’, includes curriculum opt-out provisions and forced disclosure of any ‘request by a student to identify as a gender that does not align with the student’s biological sex’. Effective date April 9, 2025. SB 104: Bathroom ban for public schools, colleges, and universities. Effective date February 25, 2025.

What’s Coming Next

There will be a slew of executive actions coming our way starting tomorrow. I am tracking them here and will send out separate posts with coverage throughout the week.

Also, the legislatures in Alaska, New Mexico, Oregon, and Utah formally start their sessions on Tuesday. Look for there to be a lot of activity in Oregon,

Action Items for This Week

Personal Impact

Mady Castigan did a fabulous deep-dive article about the impact of Florida’s policy on transgender inmates which is resulting in forcible social and medical detransition, particularly among trans women in Florida’s correction system. In it, she uncovers stories of trans women telling of their experience and the absolute necessity of continuing to receive ongoing gender affirming care.

One example is from Reiyn Keohane, the lead plaintiff in ongoing litigation challenging the policy:

Hormone therapy is necessary for me to live on a daily basis, and to complete my time in a positive and productive manner…I would like to use my time to better myself, and I try to, but this is the most important thing that can possibly be done to improve my future…Without it, I have no will to have a future at all.

Track the case of Keohane v. Dixon, case no. 4:24-cv-434 (N.D. Fla.), on the ACLU page—where more details and documents are available.

There is also a great article (courtesy of The Marshall Project) about trans prisoners describing—in their own words—their experience of incarceration. Reiyn’s story is also included there.

Build Community. Be strategic. We’re all in this together.
