✂️ “Indeed, one of Defendant's most frequent arguments is that this Court should defer to the will of the citizenry who recently re-elected him to the Office of the Executive, notwithstanding an actual guilty verdict in this case,” he wrote. “Thus, whatever stigma that might have existed, will most certainly not interfere with Defendant's ability to carry out his duties — both as President-elect and as the sitting President.” And Merchan took exceptional umbrage at Blanche and Bove’s inflammatory language, which mirrored the defendant’s conduct both in and out of court. “Counsel has resorted to language, indeed rhetoric, that has no place in legal pleadings” he scolded. “For example, countless times in their Motion to Dismiss, counsel accuses the prosecution and this Court of engaging in ‘unlawful’ and ‘unconstitutional’ conduct.” ✂️ In one sense, Justice Merchan was playing it straight when he quoted Chief Justice John Roberts’s end of year report decrying “intimidation” of the judiciary. “Disappointed litigants rage at judicial decisions on the Internet, urging readers to send a message to the judge. They falsely claim that the judge had it in for them because of the judge’s race, gender, or ethnicity — or the political party of the President who appointed the judge,” Roberts lectured, adding that “public officials, too, regrettably have engaged in recent attempts to intimidate judges — for example, suggesting political bias in the judge’s adverse rulings without a credible basis for such allegations.” But Roberts’s report is a shockingly craven document, likening legitimate criticism of the Court to intimidation. It ignores the reasons for widespread public distrust of the Supreme Court, most glaringly the immunity ruling that allowed Trump to escape accountability for his crimes. And it finger-wags at lawyers and public officials for not defending the judiciary’s sacred honor. Meanwhile, the chief justice blithely ignores the once and future president, who levels shocking abuse at judges, doxxes their family members, and ensures a torrent of death threats for judges, court staff, and prosecutors.

Supreme Court Justice Samuel Alito spoke to President-elect Donald Trump by phone Tuesday to recommend one of his former law clerks for a job in the new administration, ABC News has learned. "William Levi, one of my former law clerks, asked me to take a call from President-elect Trump regarding his qualifications to serve in a government position," Justice Alito confirmed to ABC News Wednesday. "I agreed to discuss this matter with President-elect Trump, and he called me yesterday afternoon." The call occurred just hours before Trump's lawyers on Wednesday morning filed an emergency request with the justices asking them to block a New York judge from moving forward with sentencing Trump on Friday in his criminal hush money case.

Donald Trump's nominee to lead the Department of Health and Human services has been accused by a watchdog group of committing voter fraud. The left-leaning watchdog group Accountable.US filed a complaint Wednesday morning with the New York State Board of Elections alleging that Robert F. Kennedy Jr. committed felony election fraud when he cast a ballot in the 2024 election, reported Politico. ✂️ Kennedy has argued that he was renting a room from a childhood friend in Katonah, but that individual's spouse testified that he had spent only one night there, and New York courts ordered him removed from the state ballot — which triggered a series of appeals that ended with the U.S. Supreme Court declining in September to restore him to the ballot. “Not actually living in New York in the eyes of the law allegedly did not stop RFK Jr. from casting his election ballot there illegally,” said Tony Carrk, the executive director of Accountable.US, in a statement.

In one of the most chaotic developments in a state legislature in months, the West Virginia House of Delegates has vacated a seat of a newly-elected Republican state legislator — and due to a bizarre series of events, Democrats may get to appoint his replacement, despite the seat being in a county that gave two-thirds of its vote to Trump. Delegate-elect Joseph De Soto, who ran unopposed last year after winning the GOP primary for House District 91, stumbled into an explosive and snowballing controversy even before he was elected. DragLine, a local nonprofit journalism outfit affiliated with the West Virginia ACLU, published a bombshell series of allegations, including that De Soto was not licensed to practice medicine despite claiming to be a doctor on his campaign site, and that while he served in the military, the timeline of his service doesn't line up with some of the roles he claimed to have served. Then, in December, multiple Republican state delegates questioned him behind closed doors about the truthfulness of his claimed military service and medical practice — which, according to West Virginia Watch, then allegedly led to an enraged De Soto making terroristic threats against GOP lawmakers Wayne Clark and Mike Hornby, and his subsequent arrest. ✂️ In one of the strangest twists in the saga, De Soto formally defected to the Democratic Party in December, after being elected as a Republican. Under West Virginia's procedures for filling a legislative vacancy, the Berkeley County Democratic Party may now get to nominate someone to serve out De Soto's term, even though Democrats didn't even run a candidate in this heavily Trump-supporting area last year.
