Five Days Until All Hell Breaks Loose [1]

Was that what you were thinking when you woke up on January 1, 2021?
As you nursed your coffee (and possibly your hangover) that morning, were you even remotely imagining what would happen just five weeks later at the US Capitol?
Flashing forward, are you one of those folks who believe that after that clear insurrection (not love-fest, as Trump would have it, but insurrection), Trump is ineligible to take office based on Section 3 of the 14th Amendment?
Here it is. I’m sure you’ve seen it recently, as there is currently a lot of online chatter about this subject:
Fourteenth Amendment Equal Protection and Other Rights Section 3 Disqualification from Holding Office No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
It seems so clear, doesn’t it? Or does it?
Stacy Alexander doesn’t think this gambit will work. Lance F. Rosen doesn’t either. Of course, they’re just Substackers. Over at The Hill, there seems to be consensus that Democrats can “take a stand” to prevent Trump being certified without a vote to “remove the disability” of having violated Section 3 of the 4th Amendment.
Sez The Hill:
The unlikelihood of congressional Republicans doing anything that might elect Harris as president is obvious. But Democrats need to take a stand against Electoral College votes for a person disqualified by the Constitution from holding office unless and until this disability is removed. No less is required by their oath to support and defend the Constitution.
What would that look like? Is it really possible for the Vice President to simply… not certify, and demand a vote from Congress? If so, then what? How long would the process take? Must proceedings be wrapped up prior to the official date of the inauguration?
And more importantly, are Democrats thinking along these lines, or is the die cast, and we must watch Donald Trump be inaugurated a 2nd time on January 20, 2025?
And if the die is cast, is this capitulation? Cowardice? Fear? A noble adherence to “norms” and “traditions” that is both honorable and wise? Or just a flat-out rollover, belly up, hoping our entrails don’t get snatched out by the circling jackals?
My gut is telling me that I need to stop grasping at straws, that there is no plan to use Section 3, and we’ll wake up on inauguration day to the grim sight of Frump and Melmac and their goofy, grifting spawn once again infesting our precious White House.
What says your gut?
Five days and counting…
HOLD FAST, my friends. And please let me know your hopes, as well as your nightmares, in the comments.
