Missed News: Georgia RICO Defendent Harrison Floyd Has Been Very Busy Filing Motions. [1]

Harrison Floyd and his lawyer have been busy little bees. Floyd is one of the defendents in the GA RICO case, I’m reasonably sure that Floyd will NOT take a plea deal. In fact, I have my doubts he was even offered one by Fani Willis, but I might bet the farm he wants to go to trial to prove his “innocence.” Floyd and his lawyer are busy throwing everything at the wall to see what will stick, and this strategy includes the following: 1) I don’t know the other people indicted, so how can I be a party to a RICO case?, 2) I was never “knowingly and willfully” part of any conspiracy, and 3) Trump won the state of GA, and I need to subpoena several GA officials to prove this.
For those who get confused on all the players in the GA election crime spree, Harrison Floyd was the director of an “organization” called Black Voices for Trump. He doesn’t live in the state of GA (he is from MD). But Pastor Lee who was tasked with harassing election worker Ruby Freeman called in Harrison Floyd and Trevian Kutti for help on this. Pastor Lee figured out that Ruby Freeman might cave and confess to election interference if two black people ganged up on her instead.
Fun group, huh?
First up, Floyd filed a motion to sever himself from the other defendents in this case. The argument made by Floyd’s lawyer is that Floyd doesn’t know any of the other folks in this conspiracy, so he does not want to go to trial with them. This is what all the other defendents want as well, so this is not unusual.
But Floyd’s lawyer decided to play legal definition games with the statute that Floyd was charged with to get the charges dismissed.
ATLANTA — In a new filing submitted Friday, one of the 19 co-defendants in the Georgia 2020 election RICO case is challenging the fundamental basis for his inclusion in the indictment. Harrison Floyd was the director of Black Voices for Trump in 2020 and is charged in the RICO indictment for his alleged role in the plot to coerce a "confession" of fraud from Fulton County election worker Ruby Freeman… On Friday Floyd submitted a "general demurrer" filing, essentially a challenge to its legitimacy, on the charge of violating Georgia's RICO Act. In the filing, Floyd argues the indictment brought by Fulton County District Attorney Fani Willis did not establish that Floyd "knowingly and willfully joined a conspiracy to violate Georgia's RICO Act." The filing argues the charge against him "fails to state a crime under Georgia law" because "there are no allegations that Mr. Floyd affirmatively agreed to participate in the conduct and overall objective of the alleged RICO enterprise" i.e. that he did not "knowingly and willfully" join a conspiracy to begin with.
I love that. Their argument is that where is the proof that Floyd “knowingly and willfully” participated in a conspiracy? No proof, no charge! This goes back to the severance motion. Per Floyd, “I don’t know any of those other people! How I can be knowingly and willfully joined in a conspiracy with them?”
I don’t know. Maybe because people like Rudy Giuliani said that Ruby Freeman was messing with the votes on TV and before the GA legislature? And why did you get your ass down to GA to harass Ruby Freeman? Sounds willful to me if you did all this harassment at the urging of Pastor Lee!
But the dumbest part of all of Floyd’s BS is that his lawyers are trying to subpoena several GA officials to PROVE THAT TRUMP WON THE STATE OF GA!
FULTON COUNTY, Ga. - Attorneys representing Harrison Floyd, who is facing charges related to election interference in Fulton County along with former President Donald Trump, appeared in court today. They were defending several subpoenas issued back in September as part of their defense strategy. The subpoenas are aimed at obtaining information from various entities, including the Fulton County Superior Court Clerk, Fulton County Board of Registration and Elections, and the Georgia Secretary of State's Office. The defense team is seeking records pertaining to the 2020 presidential election, including a substantial amount of material, such as images of the ballots cast in Fulton County. Floyd has argued that proving that Trump won the election in Georgia would negate any criminal intent.
All of the above leads me to believe that Harrison Floyd is a true believer in Trump, and he will not accept a plea deal. People with more criminal involvement in this conspiracy have decided to take plea deals, but here we have Floyd who must have delusions of grandeur still thinking he can prove that Trump won the state of GA. Even that grifter Sidney Powell could see the hand writing on the damn wall.
Also, I bet that Fani Willis is in no mood to offer a plea to Floyd. I bet she has sized him up, and given that Floyd harassed Ruby Freeman, I think he is a small fry who will burn.
