Although we can’t always do the great deeds, we can usually do the small. The small deeds add up.

Some of us expected it: the cheating, the lying, the chaos, and yes, even the attempts to cling to power despite the clear will of the people. But we are here to read the efforts and the positive results of those (including us and our fellow gnus) who are working so hard to save our country from those very bad people. We are furious with them for what they are doing and we are letting them know. Remember:

Voters in Iowa’s Warren County voted Tuesday to remove their recently-appointed county auditor who had shared false conspiracy theories about the 9/11 terrorist attacks, QAnon, and the 2020 presidential election, replacing him with the deputy auditor he had placed on leave after she declared her candidacy against him. Iowa’s county auditors oversee elections. Republican David Whipple’s past social media posts drew local outrage after he was appointed to the post by an all-GOP county supervisors board following the past auditor’s resignation. Enough Warren County residents signed a petition to force a special election, and Kimberly Sheets, a Democrat, and the current deputy auditor, ran against him and won. Sheets captured 66.5% of the vote to Whipple’s 33.4%of the vote) in Tuesday’s special election. The Democrat won despite Warren County’s rightward shift in recent years—Donald Trump carried the county, which lies directly to the south of Des Moines, by a 17-point margin in 2020.

🚚 Cleaner fuels replacing diesel in California Paige Bennett EcoWatch
The California Air Resources Board has announced a new landmark for the state: for the first time, over half of diesel fuel used statewide was replaced by cleaner fuels, as of the first quarter of 2023. The shift can be largely attributed to the state’s Low Carbon Fuel Standard, which is designed to reduce air pollution and greenhouse gas emissions through improving vehicle technology, decreasing fuel consumption and providing cleaner fuel alternatives.

At the start of the 2022 midterm cycle, the RNC had twice as much cash on hand as the Democratic National Committee—$80.5 million versus $38.8 million. Now, the RNC has less than half as much on hand as the DNC—$11.8 million to the DNC’s $25.4 million.✂️ “They were raising record dollars when Donald Trump was president,” one RNC committeeman said, handing the credit for that accomplishment to Trump, not McDaniel. While Trump is still the top Republican cash draw, that doesn’t do the RNC itself as much good as it once did. He’s no longer the incumbent, and with a multitude of Republican primary challengers the RNC can’t play favorites or hitch its wagon to his star. Beyond that, the Trump campaign has long taken issue with anyone who uses Trump to make a buck—the RNC included. But without the ability to dangle Trump in front of donors, the RNC’s fundraising has slowed dramatically. (At this same point in 2019—a comparable year, before the last general election—the RNC had four times as much in the bank, $46.6 million, according to Federal Election Commission records.) And members have taken note.

I wish the media would start talking to ordinary Americans whose situations are being made better by team blue. Talk to the people whose debts were slashed or zeroed out. Talk to the people who are paying less for insulin. Talk to the people who are working thanks to the infrastructure projects. Put faces and stories to what is happening, because we really need a break from the Rs and their crimes. But I will concede credit to MSNBC, because it did talk about the following:

This action is on top of progress previously made in reducing the cost of insulin to $35 a month for people with Medicare For far too long, Americans have paid more for prescriptions drugs than any major economy. But now, thanks to the Inflation Reduction Act, Medicare can directly negotiate prescription drug prices to get a better deal for seniors. Today, Medicare has for the first time selected 10 drugs for negotiation. Seniors paid $3.4 billion in out-of-pocket costs for these drugs in 2022. Big Pharma has long fought this progress. Their profits grew as they spent more on stock buybacks and dividends than they spent on research and development, even as nearly three in ten Americans struggle to afford their medications because of cost. Today, the Biden-Harris Administration is delivering on another significant milestone in implementing President Biden’s historic law to lower health care and prescription drug costs and ushering in a new era for American seniors. Over the next 4 years, Medicare will negotiate prices for up to 60 drugs covered under Medicare Part D and Part B, and up to an additional 20 drugs every year after that.

The Biden administration added another lump sum to its student loan debt forgiveness offerings: $72 million in relief to over 2,300 borrowers who attended the school formerly known as Ashford University. Why it matters: The decision follows President Biden's promise to continue pursuing student debt relief following the Supreme Court's decision earlier this summer to strike down his administration's loan forgiveness plan.
President Biden’s Justice Department is trying to close the gun-show loophole White House Briefing Room
Today, the Justice Department has announced a proposed rule to specify what exactly the new definition in the Bipartisan Safer Communities Act means on the ground. If finalized, this proposed rule would mean the following for people who are not selling guns in order to make money: If you have a gun you no longer need, and you want to sell it to your family member, you do not need a license to sell it. If you buy and sell curios or relics or “collectible” personal firearms as a hobby, again, you do not need a license. But, if you are offering a firearm for sale to make money, and telling a customer that you can purchase and sell him additional firearms, you would presumptively need a license—and need to run background checks. The same is true if you repetitively offer for resale firearms within 30 days of when you purchased them. The proposed rule includes a number of other situations where, in civil and administrative proceedings and absent reliable evidence to the contrary, it will be presumed that you need a license.

The list’s unveiling marks Biden’s most tangible step toward fulfilling his campaign pledge of lowering drug prices, and he’s already planning on making it a key part of his 2024 messaging. Lowering drug prices plays extraordinarily well across the political spectrum. Polling from the KFF, formerly known as the Kaiser Family Foundation, has found that huge majorities of Democrats, Republicans and independents believe that government regulation of drug prices is inadequate and favor the Inflation Reduction Act’s authorization of Medicare to negotiate for lower drug prices. While the GOP is generally a great friend to Big Pharma, some Republicans such as Sen. Josh Hawley of Missouri have bucked party orthodoxy and pushed for measures to involve the government in reducing prescription drug prices. It’s not hard to see why: It’s a rare policy issue that can win near-universal approval.
And ALL the Rs were against the IRA.
The MSM may not be reporting enough on this, but the White House compiled many comments. These are in the section “What They Are Saying” — which also contains comments from politicians, CEOs, and individuals. I’m doing the individuals:

Drugmaker Merck has made a fortune from patients like me who are forced to pay whatever price the company dictates. Ellen Farmer, who lives in Attleboro, Massachusetts and takes blood thinner Xarelto to treat her atrial fibrillation: “I was shocked and terrified when the pharmacist told me the monthly copay for Xarelto after insurance would be $1,000. There was no way I could afford that! Johnson & Johnson, the drug company that makes Xarelto, has increased the price of its medicine by more than 111 percent since it first entered the market 12 years ago. The fact that Xarelto is on the first list of drugs to be negotiated gives me so much relief.” [Statement from Patients for Affordable Drugs, 8/29/23]
Judy Aiken of Portland, Maine who lives with autoimmune disease psoriatic arthritis and psoriasis: “Enbrel costs me around $330 a month with my Medicare advantage plan – and its list price is over $7,000. This type of pricing unfairly takes advantage of those on Medicare, many of whom, like me, live on a fixed income. Seeing Enbrel on the list of drugs to be negotiated first allows me to take a deeper breath and honestly live a better life. Enbrel’s high price has been a real burden, a constant anxiety. A better deal on this drug is life changing for me and thousands of patients.” [Statement from Patients for Affordable Drugs, 8/29/23]
Esther Lumm, of Honest, Arizona, who lives with diabetes: “Diabetes is a life-long disease that requires constant attention and easy, reliable access to insulin and other medications to keep the disease in check. For Arizonans on Medicare like myself, rising and unpredictable prescription drug costs are a threat to our health care and to our ability to make ends meet. I’m grateful to the members of our congressional delegation who passed the Inflation Reduction Act and to the Biden administration for placing a check on the pharmaceutical corporations to make these prescriptions more affordable.” [Statement, 8/29/23]

In a meeting of the Global Environment Facility (GEF)’s Seventh Assembly in Vancouver, Canada on Thursday, representatives from 185 countries agreed to launch a new global conservation fund, with Canada pledging 200 million Canadian dollars and the United Kingdom contributing 10 million pounds. The United Nations is seeking contributions for the protection of 30 percent of terrestrial and coastal areas by 2030. “The new Global Biodiversity Framework Fund (GBFF) has been designed to mobilize and accelerate investment in the conservation and sustainability of wild species and ecosystems, whose health is under threat from wildfires, flooding, extreme weather, and human activity including urban sprawl,” a press release from the Global Environment Facility said.

Voting rights. This may be the biggest issue threatening our democracy right now. Besides contacting your representatives at the state and federal level to do the right thing (depending on who they are), you can support and contact these organizations:

Democracy Docket — founded by Marc Elias, so important in fighting the challenges after the last election.
Fair Fight — founded by Stacey Abrams
🌱Grass roots. Biden and Harris can do the top-down stuff, but we have to support from the bottom. I don’t know how to deprogram 75 million people, but some things have been written about, such as deep canvassing, and lots of people are talking about this. If you know someone (who did not storm the Capitol), then see if you can be pleasant. Instead of trying to reason with them (logic is obviously not their strong point) distract them with something else. We need to remove the sources of lies and to take down the temperature. If we get more of the Rs to wear masks and to get vaccinated and to vote for Ds, the country will be a better place. We need to coax some of them out of the rabbit holes and diffuse the anger and the crazy.
🏃 Run for something. If you want to run for something, but have no idea what to do, these people will help you. They also like money and volunteers to help those people who are running, so even if you’re not in a position to stand for office, you can help. Note: they are especially planning to target the 57 Rs in local governments who participated in the insurrection.
👎 Defund the seditionists. Defund the seditionists. This is a list with companies that sometimes have donated to the seditionists. The list is long. You will recognize many of the corporations, and you probably have a relationship with some — either you are a customer, a shareholder, or maybe even an employee. Contact them and compliment or complain, but let them know you are watching. Forward it to others.

For years, the Trump way — ignore lawful subpoenas, assert unfounded exemptions from compliance and generally run out the clock on legal claims — has been distressingly successful. Stonewalling has proved a particularly successful strategy in the face of congressional investigations. But that approach has its limits, on welcome display this week in D.C. federal court, where two judges rendered powerful rulings against Trump advisers Rudy Giuliani and Peter Navarro that amounted to: Stop this nonsense. It’s not nice to fool with federal judges. They possess the power to rule against you, especially when you push the limits. This week’s first case in point is U.S. District Judge Beryl A. Howell, presiding over a lawsuit brought by two Georgia election workers, Ruby Freeman and her daughter Wandrea ArShaye “Shaye” Moss, who claim Giuliani defamed them when he accused them of tampering with the election results. Giuliani, through his own obstructionism, managed the feat of losing the case before it went to trial. Howell simply ruled against Giuliani, citing his repeated and flagrant failure to comply with his legal obligations to turn over relevant information to the other side. ✂️ Howell’s bottom line: Giuliani gets to go to trial — but only on the question of how much money he owes. “Rather than simply play by the rules designed to promote a discovery process necessary to reach a fair decision on the merits of plaintiffs’ claims, Giuliani has bemoaned plaintiffs’ efforts to secure his compliance as ‘punishment by process,’” Howell wrote. “Donning a cloak of victimization may play well on a public stage to certain audiences, but in a court of law this performance has served only to subvert the normal process of discovery in a straightforward defamation case, with the concomitant necessity of repeated court intervention.”

U.S. District Judge Amit Mehta shot down former top Trump White House economic adviser Peter Navarro’s argument that Donald Trump asserted executive privilege over testimony Navarro was subpoenaed to give to the Jan. 6 House select committee in winter 2022. “There was no formal invocation of executive privilege by [Trump] after personal consideration nor authorization to Mr. Navarro to invoke privilege on his behalf,” Mehta said, according to Politico reporter Kyle Cheney. That means his trial for contempt of Congress will begin next week, with jury selection slated to start September 5.

A handful of firms associated with Trump made a last-ditch effort to hide documents that detailed the way they unwittingly became part of the Trump Organization’s alleged scheme to inflate assets. But the judge, Arthur F. Engoron, ruled that—aside from information like the home addresses of certain employees and bank account numbers—the public has a right to see the documents and communications. The former president is just 34 days away from heading to civil trial in New York City, where his personal finances will be put under a microscope while the state’s AG tries to bleed his corporation dry over the way it routinely overstated its holdings on official documents. But with that trial around the corner, the companies that kept lending him hundreds of millions of dollars for business deals are trying to quietly slink away into the shadows—and hide the paperwork that shows how they played along. Zurich American Insurance Company, WSFS Bank, Ladder Capital and others earlier this month asked the judge overseeing the case to seal documents that detailed the way they communicated with the Trump Organization while they evaluated its assets..
I admit I worked in the insurance industry and I don’t like the enablers, because they would cause serious losses while getting rewarded. Although I sometimes have wondered if it is fraud when the banks and insurance companies know they are getting lied to… but then the risk is pushed on to others and that is wrong.

Judge Beryl Howell, who just declared Giuliani liable for what he did to Ruby Freeman and Shaye Moss Eric Uebelacker, The Daily Beast
Rudy Giuliani on Wednesday lost his defamation suit from two Georgia election workers after a federal judge deemed him unable to produce and preserve substantial electronic evidence or respond to subpoenas, resulting in a “default” judgement. In a fiery 57-page ruling from U.S. District Court Judge Beryl Howell, Giuliani was chided line after line for “donning a cloak of victimization” and undermining the discovery process in what should have been a “straight-forward defamation case.”

Protasiewicz is part of a 4-3 liberal majority on the court, and her election ended a 15-year run of conservative justices in control. Two redistricting lawsuits were filed in the first week after Protasiewicz joined the court on Aug. 1. Republicans argued in their recusal motion that “Justice Protasiewicz’s campaign statements reveal that her thumb is very much on the scale in this case.” During her winning campaign, Protasiewicz called the Republican-drawn maps “unfair” and “rigged” and said there needs to be “a fresh look at the gerrymandering question.” Protasiewicz never said how she would rule on a redistricting lawsuit. ✂️ It would take only a simple majority vote in the Assembly to impeach Protasiewicz, and a two-thirds majority vote in the Senate to remove her from office. Republicans have a 65-34 majority in the Assembly and a 22-11 majority in the Senate.
She really could get impeached, which would super suck, but good on her because she told the truth.

..After Chutkan ruled, Lauro stood to make an objection on the record and state that Trump’s defense team will not be able to adequately represent its client with that trial date. Chutkan noted his objection and moved on. Earlier in the hearing, Chutkan said that while the special counsel team's proposal was too soon, Trump's proposal of 2026 was not reasonable. “Discovery in 2023 is not sitting in a warehouse with boxes of paper looking at every single page,” Chutkan said. “This case is not going to trial in 2026,” Chutkan said. She said Trump's team has had time to prepare already; the public has known about the existence of the grand jury investigating Trump since September, and the identity of many of the witnesses has been known.

After an offensive lasting almost five weeks, Russian troops withdrew in the face of Ukrainian defiance. But for Ivan, a more personal battle was just beginning. His history of panic attacks and anxiety, which predated the war, came surging back. He began to experience trouble breathing if he ventured too far from his home near the Dnipro River, which passes through three countries and had become a key front line in the war against Russia. That’s when he sought out TeleHelp Ukraine, a virtual health service co-founded by Stanford University medical student Solomiia Savchuk in April 2022. Over the course of around 12 virtual mental health support sessions, in which Ukrainian native Savchuk acted as an interpreter, Ivan was able to regain the ability to drive without suffering a panic attack. He learned breath and visualization exercises, and regularly drew graphs to numerically express how he was feeling on a particular day. As an avid cyclist, he felt most comfortable on a bike, and so would take cycling trips that allowed him to venture slightly further from the city and river each time, until he felt confident enough to get back behind the wheel of his car and drive longer distances. Eventually, Ivan was able to drive far enough to visit his family, in time to meet his newborn grandson.

Insects provide many essential benefits to ecosystems, including pollinating crops and flowers, helping to maintain healthy soil and recycling nutrients. They also keep populations at healthy levels through their own food chains. A new project by researchers from the University of Melbourne has found a way to increase insect species numbers in a small urban greenspace by seven times, illustrating the importance of urban greening projects, a press release from the British Ecological Society said. ✂️ Starting in the spring of 2016, the research team began turning a grassy urban lawn with two trees in Melbourne, Australia, into a habitat for a dozen species of indigenous plants. The team used soil decompaction, fertilization, new topsoil and organic mulching to create the urban oasis. Over the course of the next three years, the researchers conducted 14 insect surveys, collecting samples of bees, wasps, ants and other insects, for a total of 94 insects, 91 of which were endemic to Victoria.
