Willis Wants ALL Defendants Fast-tracked for Trial [1]

Willis filed this motion with the Fulton County court this afternoon:

COMES NOW, the State of Georgia, by and through Fulton County District Attorney Fani T. Willis, and requests this Honorable Court to clarify or, in the alternative, partially set aside its Case Specific Scheduling Order entered on August 24, 2023, to the extent that the Order states, “[a]t this time, these deadlines do not apply to any co-defendant,” for the reasons set forth below. . . . The State maintains its position that severance is improper at this juncture and that all Defendants should be tried together, but at an absolute minimum, the Court should set Defendant Powell’s trial and that of any other defendant who may file a speedy trial demand on the same date as Defendant Chesebro’s.

Technically, it’s a request for clarification that the original order did not “at this time” apply to any other defendants (a phrase that I puzzled over when I first saw it). Willis points out that

[B]ecause Defendant Chesebro has not filed a motion to sever and because the Court has held no hearing on a motion to sever, the State of Georgia respectfully requests that the Court set aside its Case Specific Scheduling Order entered on August 24, 2023, to the extent that the Order states, “[a]t this time, these deadlines do not apply to any co-defendant.”

Finally, if any defendant does want to sever their case from Chesebro’s (and his speedy trial date), Willis wants the court to require a motion to sever be filed very soon, so as to give her time to respond:

The State of Georgia further respectfully requests that the Court set a deadline for any Defendant wishing to file a motion to sever, allow the parties, including the State of Georgia, sufficient time to brief the severance issue, and hold a hearing on any filed motion to sever so that the Court may consider the factors set forth in Cain and its progeny, as required by Georgia law.
