Question? Why has assets not been seized according to Fl Forfeiture Law. Only arrest necessary. [1]

I wonder why there has not been a hold on monies, assets, but especially Maralago according to this.

Assets or property were seized pursuant to a Federal investigation, Federal law applies and the standards for review and return of property are somewhat more complex (and friendlier to government agencies). Federal forfeitures can involve administrative hearings regarding the property, or the asset issue can be made part of the criminal case – where a conviction means forfeiture of the asset.

This might seem surprising to some, but both Federal and State agencies have legal authority to start this process without your permission. Under the Florida Contraband Forfeiture Act, the State can seize “any personal property” – including any type of vehicle, boat, machine, etc. – if they can demonstrate a “nexus” between the item seized and illegal activity.

Defendants have important rights in asset forfeiture cases, particularly under Florida law. At the trial stage, local law enforcement agencies bear a high burden – beyond a reasonable doubt – of showing your property was connected to criminal activity before it can be transferred to the State. If they seized cash or financial accounts, for example, they must show those were ill-gotten gains from criminal acts, and not unrelated income. In vehicle cases, they need to show that the car was used to transport contraband, or used to commit a specific crime.

Was not classified documents found at Maralargo? Was this not an alleged crime? He was arrested for said crime. The alleged crime happened on his property and documents were transported via his jet.

Same thing for New Jersey? Classified documents in NJ were held up and how did they get there without his plane transportation?

Now the Property Manager has been arrested. Why has this property and the Jet that transported documents not seized?

Why have bank accounts not been frozen regarding his taxes and illgotten monies on fraud charges? No conviction necessary...Just arrests.

There are actuall two questions. Would he have to received monies for the crime at Maralargo? What about all of this fundraising on illegal activity?

7)(a) Property may not be forfeited under the Florida Contraband Forfeiture Act unless the seizing agency establishes by a preponderance of the evidence that the owner either knew, or should have known after a reasonable inquiry, that the property was being employed or was likely to be employed in criminal activity.

Inquiring minds want to know and I am not a lawyer. This is not just about drugs…. Illegal acts are illegal acts. Maybe it has to go to trial but it is in the courts from DC to Georgia on illegal activity. He has been indicted several times, how can he still hold on to his mostly illgotten gains? Also, is he still getting presidential monies for former presidents?
