The 14th Amendment Section 3 Isn't an Automatic Magic Solution and Beau of 5th Column Says Why [1]

So as you may know, there are many, MANY justifiable calls by Congress to chuck out their Republican… “”colleagues”” who obviously and plainly participated in the Insurrection by voting to overturn the votes for Biden to become President. However Beau of the 5th Column recently reflected my thoughts in an eloquent manner.





At about 3:50 is where he presents the ideas I’m focusing on, that Republicans could abuse it to heck and back by disqualifying Biden then and there in an obviously partisan manner. The example he gives is Texas lawmakers labelling Biden unfit under 14th Amendment Section 3 because he’s not “keeping immigrants out of the border”, at least not as much as these hypothetical Texas lawmakers could want. The immigrants in this instance would be labelled “insurrectionists”… Somehow and thus Biden would be “”aiding in an insurrection”” by their terms.



Now, my example is Zooey Zephyr of Montana. She was rightfully protesting Republican lawmakers silencing her for protesting bans on gender affirming care for minors. If the 14th Amendment could be used in such a manner she would be out of office like that and we would lose a progressive trans lawmaker on our side just because Republicans could use just about anything as an excuse, labelling it an “insurrection”.



Now listen, I want every single Republican who participated in the Insurrection to get chucked out of office so fast they leave a flame trail in their wake as they slide along the sidewalk from sheer momentum. But if the 14th Amendment is THAT automatic as Beau describes, it becomes a wizard duel among Democrats and Republicans on who can fire their 14 Amendment faster. Due process is slow, real slow, but it’s all we have. Is due process coming for those who aided in Jan. 6 besides just Trump and thousands of lackies? I couldn’t say but I can almost swear I can hear Jack Smith sharpening his axe as I type this out.
