What Trump’s Lawyers want. [1]

Trump’s Lawyers want him to be able to share evidence with “advisors” and “unpaid Lawyers” as well as with his trial Lawyers.

Is this common practice? Would “advisors” include Jared and Ivanka? What about Roger Stone and Steve Bannon? What about Putin?

Trump’s Lawyers also argue that he should not need to get the Court’s approval prior to sharing evidence with these random “advisors”. If the Judge agrees I certainly hope Trump will indeed be required to provide a list of these “advisors” and “unpaid Lawyers” and have each one of them approved by the Judge in advance!

Donald Trump argued Monday that he should be allowed to share evidence in his latest criminal case with “volunteer attorneys” and other unpaid advisers as he prepares to defend himself against charges related to his effort to subvert the 2020 election. “The government cannot preclude the assistance of those individuals, nor should President Trump be required to seek permission from the Court before any such individual assists the defense [sic],” Trump’s attorney John Lauro wrote in a filing that seeks to govern the handling of the mountains of evidence prosecutors have gathered and are preparing to share with Trump’s team.



Trump’s Lawyers also want to narrow the the restriction on evidence that Trump cannot share publicly to only those materials that are considered “sensitive”.

I wonder what the Judge will say to that? If Trump can disclose any evidence at all, we can expect lots more of his online rants. True, those are always interesting, in a car crash kind of way, but not if you are the target and receive death threats after his rant.

Whatever line is imposed he’s sure to cross it and claim it was a mistake. Give Trump an inch and he’ll always take a mile.

”Lauro said the blanket restriction on disclosing any evidence prosecutors provide is draconian and should be narrowed to limit the treatment only of materials deemed “sensitive” — such as those containing personally identifying information, grand jury subpoena returns, sealed search warrant returns and recordings or transcripts of witness interviews. “Rather, the Court can, and should, limit its protective order to genuinely sensitive materials — a less restrictive alternative that would satisfy any government interest in confidentiality while preserving the First Amendment rights of President Trump and the public,” Lauro wrote.

Another thing Trump’s Lawyers wanted to do today was to firmly plant the lie, in people’s minds and in the Court documents, that Trump’s Conspiracy trial is “a trial about First Amendment Rights”.

They certainly seem to want to push that angle. I expect Jack Smith will push back on that incorrect assessment of the trial by the Defence Lawyers and hope the Judge does too. As we know, this is not a trial about first amendments rights but rather a trial about his conspiracy to overturn the 2020 election results.

Donald Trump's lawyers on Monday urged a Washington, D.C., federal judge to restrict only "genuinely sensitive materials" in the former U.S. president's 2020 election case from being released to the public ahead of trial. "In a trial about First Amendment rights, the government seeks to restrict First Amendment rights," Trump's lawyers said in court papers filed on Monday, referring to the right of free speech guaranteed by the U.S. Constitution.

I can hardly wait to see the responses from Jack Smith and the decisions of Judge Tanya Chutkan. I sure hope we won’t have to wait long. It’s so intriguing to follow all these moves and counter moves.
