Thursday Good News: Arraignment Day! [1]
['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.']
Date: 2023-08-03
It’s a big day for Democracy, the Rule of Law, Motherhood, and—What’s your favorite pie? (As Churchy once said in a Pogo strip, “Anything handy is purty favorite.”) It’s a big day, too, for paskudnyakery in all forms that we have to push back on. (See Funny or Fuggedaboudit below for early pointing and laughing) Our first order of business today is the indictment itself, which is just chock full of our kind of Good News. And there’s plenty more where that came from.

IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA
UNITED STATES OF AMERICA
v.
DONALD J. TRUMP Count 1: 18 U.S.C. § 371 (Conspiracy to Defraud the United States)
Count 2: 18 U.S.C. § 1512(k) (Conspiracy to Obstruct an Official Proceeding)
Count 3: 18 U.S.C. §§ 1512(c)(2), 2 (Obstruction of and Attempt to Obstruct an Official Proceeding)
Count 4: 18 U.S.C. § 241 (Conspiracy Against Rights) INTRODUCTION
1. The Defendant, DONALD J. TRUMP, was the forty-fifth President of the United
States and a candidate for re-election in 2020. The Defendant lost the 2020 presidential election.
And it all went downhill from there.
Indictment Good News
WaPo, not paywalled:
Read the full text of the 45-page Trump Jan. 6 indictment document The released indictment below details the full charges, including conspiring to defraud the United States, conspiring to obstruct an official proceeding, obstructing a congressional proceeding and conspiracy against rights: Civil War-era rights law key in Trump election interference charges It was central to the 1967 trial of more than a dozen Ku Klux Klan members who conspired to murder three civil rights workers, a case immortalized in the 1988 film "Mississippi Burning." Pence speaks on Trump indictment in 2020 election interference probe
Trump's arraignment on federal charges: Here's what to expect
Trump has been summoned to appear at 4 p.m. ET on Thursday before Magistrate Judge Moxila A. Upadhyaya at the federal courthouse in Washington, D.C. The case has been randomly assigned to U.S. District Judge Tanya S. Chutkan. Chutkan was appointed to the bench in 2014 by then President Obama, and has presided over the trials of numerous defendants in Jan. 6-related cases.
538: Is This The Indictment That Really Hurts Trump?
A June 22-26 poll from the Associated Press-NORC Center for Public Affairs Research found that only 35 percent of U.S. adults thought Trump did something illegal when it came to the hush-money payments. But 53 percent thought he did something illegal with regard to the classified documents found at his Mar-a-Lago resort in Florida. By this logic, this third indictment could be even more damaging to Trump than the one involving classified documents. According to the same YouGov/Yahoo News poll, 69 percent of registered voters considered it a serious crime to attempt to obstruct the certification of a presidential election, and 71 percent said the same about conspiring to overturn the results of a presidential election.
We don’t need it to wipe him out. We want it to shave a few points from his support, enough to solidify our gains and swing a few more states than Biden won in 2020. We want big enough majorities in the House and Senate so that a few troublemakers can’t derail our agenda. And similarly, we want to win control in a few more states—governors, legislatures, Supreme Courts…
Of course, if we get more than that, we can wear ourselves out binkying (below).
Oh, and how about the other charges against Trump’s co-conspirators, who will be indicted later, in part so as to keep this case as simple as possible, and not invite endless delay from attorneys for multiple defendants.
a. Co-Conspirator1, an attorney who was willing to spread knowingly false claims and pursue strategies that the Defendant’s 2020 re-election campaign attorneys would not. b, Co-Conspirator 2, an attorney who devised and attempted to implement a strategy to leverage the Vice President’s ceremonial role overseeing the certification proceeding to obstruct the certification of the presidential election. c. Co-Conspirator 3, an attorney whose unfounded claims of election fraud the
Defendant privately acknowledged to others sounded “crazy.” Nonetheless, the Defendant embraced and publicly amplified Co-Conspirator 3’s
disinformation. d. Co-Conspirator 4, a Justice Department official who worked on civil matters and who, with the Defendant, attempted to use the Justice Department to open sham election crime investigations and influence state legislatures with knowingly false claims of election fraud. e Co-Conspirator 5, an attorney who assisted in devising and attempting to implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding. f. Co-Conspirator 6, a political consultant who helped implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding.
CNN: Who are the Trump co-conspirators in the 2020 election interference indictment?
Co-Conspirator 1 is former Trump lawyer Rudy Giuliani.
Co-Conspirator 2 is former Trump lawyer John Eastman.
Co-Conspirator 3 is former Trump lawyer Sidney Powell.
Co-Conspirator 4 is former Justice Department official Jeffrey Clark.
Co-Conspirator 5 is pro-Trump lawyer Kenneth Chesebro.
The identity of Co-Conspirator 6 is unclear. The indictment says [he is] “a political consultant who helped implement a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding.” The indictment also further ties this person to the fake elector slate in Pennsylvania.
And how about the fake electors in six more states, now that Michigan has indicted its own fraudsters? And hundreds more people still being sought by the FBI for J6 violence. We get these every day.

MICHegas
Oh, BTW, ICYMI, in addition to the indicted fake electors,
Matt DePerno, ex-Rep. Daire Rendon charged in Michigan voting machine probe
Republican former attorney general candidate Matt DePerno and GOP ex-state Rep. Daire Rendon are facing criminal charges for their alleged roles in an effort to access Michigan voting machines after the 2020 presidential election. Special prosecutor D.J. Hilson confirmed the charges Tuesday afternoon, saying his investigation into the handling of tabulators in Michigan was "ongoing and not over," which could mean other individuals will be charged.
They and others intimidated election workers to get possession of voting machines, in order to run bogus tests in unsecured locations, etc. etc.
So there is more where that came from, too.

x You can tell that Trumpers haven't #ReadTheIndictment because 1st Amendment is trending.
Per the indictment, Trump had a right to lie and even challenge results through lawful means. But he doesn't have the right to pursue unlawful means to subvert the will of the people. pic.twitter.com/Ky4Qob5TZU — Blake London (@blakejlondon) August 2, 2023
Trump has tried out various privilege defenses. Courts consistently said no.
Now it’s 1st amendment. Courts have said no.

x There's always one key word that any legal situation has to address: INTENTION.
We have, without a doubt, a multitude of language and witnesses who can attest to Trump's intentions. One that is most compelling is his conversations with Mike Pence.
