Pramila Jayapal’s statement that Israel is a racist (and Apartheid) state is legally correct. All provisions of the definition of Apartheid apply to Israel’s policy towards Palestinians. You can see Amnesty International, Human Rights Watch, and B’tselem’s extensive documentation of this reality.

In terms of racism?

Racism is legally defined by the International Convention on the Elimination of All Forms of Racial Discrimination. …..any distinction, exclusion, restriction or preference based on race, colour, descent, or national or ethnic origin which has the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise, on an equal footing, of human rights and fundamental freedoms in the political, economic, social, cultural or any other field of public life

Israel’s discrimination towards Palestinians, in all areas that it controls, is based on national or ethnic origin.

The political problem with the term racism (or racial discrimination) is that, colloquially and academically, it is often differentiated from ethnic discrimination and hatred. No one has referred to Russia’s invasion of Ukraine as a racist act. (google search it). Yet legally, Russia’s invasion is a racist according to the Convention.

Given the enormous support that Israel has from Democrats and Republicans elites, it is understandable that she was attacked and that she chose to clarify her remarks and vote for the pro-Israel resolution. As the US did for many decades with South Africa, both parties have made fools of themselves internationally by claiming Israel is not an Apartheid state. US policy towards Israel (and Palestinians) must change and we need to defend those, like Pramila Jayapal, the Squad and others for speaking truth to power.
