I Support President Biden, But He Is WRONG About Not Wanting To Reform The SCOTUS. [1]

I wan’t initially a supporter of Joe Biden during the primaries, and he and his supporters proved me wrong about what it would take to win in 2020. I’ve publicly admitted that Biden supporters were right, and I was dead wrong. And I support Biden’s Agenda. It’s been the most progressive we have had since 1980. And that is a long damn time to wait for a truly transformational political agenda. However, President Biden is wrong when it comes to reforming the corrupt Supreme Court. Being apolitical when it comes to “respecting institutions” is not going to work with the Supreme Court. The voters are going to have to demand that Democrats embrace expanding the Supreme Court.

I realize that Biden wants to work within norms and political institutions to achieve policy goals. It’s not just a pose on his part. He has lived this way since 1973. And being apolitical looks very, very good to “independent” voters in elections (I don’t believe in real independent voters. They are nothing but weak partisans, and there is political science data to back that up). It’s very non-threatening, so how could Republicans paint President Biden as some type of political extremist?

However, you cannot be apolitical with a corrupt, POLITICIZED institution. And how the Supreme Court was packed with political hacks was completely political. Republicans destroyed political norms to achieve a reactionary court that is returning us to a time when women are second class citizens. People of Color are having their voting rights threatened, just like the good old days during Jim Crow. Oh, and POC shouldn’t complain about racism because it just doesn’t exist in the Constitution. Therefore, no more Affirmative Action. And now, businesses can now openly discriminate against same sex couples.

Think this will get any better without some other progressive justices on the Court?

Look at what they did with the EPA and environmental laws. They are making it easier for polluters to keep pumping carbon dioxide into the atmosphere, and we have a climate change CRISIS going on. The Supreme Court is trying to kill the planet by helping the fossil fuel industry.

And this Court just made up some “legal” theory to strike down Biden’s attempts to help out with the Student Loan Crisis (The “Major Question” Doctrine). What else is on the chopping block for the Court? With regards to this recent ruling on student loan debt forgiveness, the Court not only defanged the Executive Branch but the Legislative as well. The Court will now say what is and isn’t allowed.

How is that a tenable situation for Democrats and President Biden?

What is going to have to happen is that Democratic base voters are going to have to make reforming the Court a high priority issue in next year’s election. And this means EXPANDING the Court! Democratic candidates for the House and Senate are going to have to pressed to expanding the Court. And President Biden is going to have to hear from Democrats that reforming the Court is mandatory for their votes in 2024.

I would suggest that whenever President Biden has some townhall or takes questions from voters that this issue needs to be brought up again and again. We should call the White House, email, and write letters to demand Court reform. As with FDR, Biden is going to need to be “dragged” into fighting for expanding the Court.

Our democracy and rights are under attack. Many of us are having rights being taken away. It’s only going to get worse without expanding the Supreme Court.
