First IANAL.
Hunter’s diary Mystery: Why hasn't the FBI searched Trump's other properties? had the fur flying yesterday. You had Garland/DOJ/FBI being attacked from one side and Garland et al, being defended from the other. And from what I could tell both sides had lawyers and non lawyers in the discussion.
On 18 November 2022, Attorney General Merrick Garland appointed career DOJ prosecutor Jack Smith as Special Prosecutor, so regardless of what one thinks about what or when the DOJ/FBI should have searched what Trump properties and when, you should be looking at Jack Smith now and not what Merrick Garland did or didn’t do.
My take is, I think Jack Smith is on it. How? I don’t know and neither do any of the rest of us. We can speculate, but we don’t know. My speculation? Smith is watching any and all the other Trump properties he suspects Trump may have or may move any additional documents. I would also suspect that Smith has eyes on these locations, both agents and informants.
Why hasn’t Jack Smith raided? He might be waiting for several reasons. Again, I’ll speculate. He’s waiting to see what Cannon does. He just sent Trump and his team everything he has… In Florida. NJ and any other locations might open new counts against Trump in other, multiple jurisdictions for another day. Maybe he’ll search those in the middle of any trial in Florida. Maybe he’ll search them if Trump’s team or Cannon create delays, or start delaying unnecessarily. Who knows? Certainly none of us. If I were Jack Smith, I would be sitting back to see just how stupid Trump and some on his team really are. The old saying about keeping your powder dry comes to mind. MAL is just the opening salvo, give it time. (There’s a scene from the movie Force 10 From Navarone comes to mind. It’s the scene where everyone wants to know why an explosion didn’t immediately destroy the dam. Edward Fox’s character knew their small explosion wouldn’t immediately cause a catastrophic collapse, but would create the cracks in the structure that would, given time.)
At this junction, Jack Smith has done nothing to cause me to not trust his judgement. However, I reserve the right to change my mind. So for now I say, give him time.
