Charlie Sykes Brings Us Simplicity When Considering Recent MAL Documents Case Developments. [1]

Yes, I know that Charlie Sykes helped create the Frankenstein Monster that is the modern GOP, but he brought another moment of clarity and simplicity when considering the most recent developments of Trump’s stealing classified documents (I have jumped the gun and called it theft, but I’m not a prosecutor). This was on Nicole Wallace’s Deadline White House. To wit, there are three things to keep in mind that scream “Trump will be indicted!”
Judge Beryl Howell’s ruling that the “crime fraud exception” applied to breaching attorney-client confidentiality between Trump and one of his lawyers, Evan Corcoran.
Today’s meeting between Trump’s remaining lawyers and Special Counsel Jack Smith.
Trump’s explosion on Truth Social.
First up, Sykes reminds us that Jack Smith had to have EVIDENCE THAT TRUMP COMMITTED A CRIME using his lawyer, Evan Corcoran, to convince Judge Beryl Howell to make her ruling that the crime fraud exception could be applied and compel Corcoran to testify to Smith’s grand jury.
WASHINGTON — Special counsel Jack Smith's office presented sufficient evidence to establish that former President Donald Trump committed a crime through his attorneys, a U.S. district judge ruled Friday night, a source briefed on the proceedings confirmed to NBC News on Wednesday. U.S. District Judge Beryl Howell, based in Washington, D.C., wasn't ruling on whether Trump was guilty of a crime but was making a decision about whether his attorney could be compelled to testify. As a result of the decision, Howell ruled in favor of applying the “crime fraud” exception, which would let prosecutors sidestep protections afforded to Trump lawyer Evan Corcoran through attorney-client privilege. Howell also ruled in favor of ordering Corcoran to testify before the federal grand jury. The development was first reported by ABC News.

If you have evidence of a crime having been committed, are you REALLY not going to indict the perp?
I think that gets lost by most in the media.
Next, as other lawyers on MSNBC have been saying all day, a prosecutor will give the subject of the investigation one last time to come in and make his/her case on why they should NOT be indicted. This is at the end of the investigation, and by this time, the prosecutor has decided to indict the perp, unless there is some new evidence that says, “Hold the horses!” And the perp is invited in to present a case of “Look at this piece of evidence! Surely, you cannot indict me now?!”
Most of the time, the perp is doomed at this point. And to prove the point that Trump’s lawyers came up empty and had to march out of the building with nada, look at how Trump responded on his Twitter wannabee Truth Social.
Former President Donald Trump took to his social media website Monday to ask how the Justice Department could charge him in its probe into how he handled national security documents minutes after his attorneys were seen leaving the department. "How can DOJ possibly charge me, who did nothing wrong, when no other president's were charged," Trump wrote in all caps on Truth Social. He noted that Hillary Clinton was investigated by the FBI for having classified information on her private email server and "wasn't even close to being charged! Only Trump — the greatest witch hunt of all time!"
This is a tell from Trump. Whenever things are starting to turn to shit for Trump, he screams on Truth Social. And he goes into real panic mode whenever it deals with something that he cannot control or bully. Like maybe being indicted and appearing in court. Just ask Alvin Bragg.
Will Trump be indicted this week? Hell if I know. But all signs point to a wrap up of the Mar-a-Lago document case.
And as other lawyers and legal analysts have pointed out, time is a wasting for a federal indictment of Trump. Jack Smith has been under the gun to investigate and see if there was enough evidence of Trump committing a crime. Going back to Judge Howell’s ruling, Smith has evidence of a crime. But the election season is drawing near, and the time is right about now to get indictments in to have a trial before November 2024.
