ChatGP can be hazardous to your career - now appearing in the legal field. [1]

CNBC has a story here about the use of ChatGPT that should surprise none of us here. It appears, however, that members of that vocational community that prides itself on its research skills failed to do any minimal due diligence about using ChatGPT. The headline is:

ChatGPT cited ‘bogus’ cases for a New York federal court filing. The attorneys involved may face sanctions

This was a case of an individual suing Avianca Airlines for injuries from being hit by a serving cart. Avianca moved to dismiss the case and Peter LoDuca, the plaintiff’s attorney filed a response. Avianca and its attorneys told the judge they couldn’t find the cases. The judge demanded to see the case documents.

But it appears that the law firm didn’t just use ChatGPT to create the citations but, amazingly, used it to produce the actual court decision language to file with the court.

Avianca’s attorneys told the court that it couldn’t find numerous legal cases that LoDuca had cited in his response. Federal Judge P. Kevin Castel demanded that LoDuca provide copies of nine judicial decisions that were apparently used. In response, LoDuca filed the full text of eight cases in federal court. But the problem only deepened, Castel said in a filing, because the texts were fictitious, citing what appeared to be “bogus judicial decisions with bogus quotes and bogus internal citations.”

Don’t worry — a fall person has been found. A lowly associate indicated that he had been “tooling around on ChatGTP” and was solely responsible for the errors. That could explain the citations in the brief but in no way would account for the follow on filings of the decisions by a partner. The judge seems to think so too.

The attorney and law firm now have a follow on hearing scheduled with the judge for June 8.
