Ms. Carroll, we all owe you an enormous debt of gratitude for your courage, your determination and your victory. You have inflicted a grave wound to TFG.
But the job is not finished. TFG continues to defame you. He is unrepentant. The CNN “town meeting” proves that the jury verdict finding that his statements about you are lies will not prevent him from repeating those lies in the future.
Fortunately, you are uniquely positioned to do something no one else has ever been able to do to Donald Trump—put a muzzle on him. Prevent him from saying anything negative about you again, ever.
Victims of defamation in New York have the right to seek an injunction against ongoing and future defamation.
The legal criteria for an injunction are:
A clear legal right—your right not to be defamed, (which has been established by a jury); The likelihood or certainty that TFG will violate that right, (see CNN); That irreparable harm will happen as a result of TFG’s actions, (the jury has found TFG’s lies damaged your reputation), And, that availability of civil damages is inadequate to deter future defamation and compensate you. (The verdict against TFG has had no effect on his conduct).
It seems that you have a very, very, very strong case.
When you succeed, you could receive an order which says:
Defendant, Donald Trump, is prohibited from:
Stating or implying that he did not sexually assault you; Stating or implying anything negative about you at all; Making any statement about the jury verdict other than that he disagrees with it; Use your imagination---if you ask for it, you might get it.
TFG’s modus operandi is to lie and to lie and to lie again. On the campaign trail, the subject of your verdict against him will come up.
Wouldn’t it be wonderful if, for once, a court prohibits him from repeating the lies he has told about you, under penalty of contempt?
You can do it. You can put a muzzle on TFG.
