With the end of the Trump-era public health order, Title 42, America is once again engaged in anxious navel gazing as we once again try to find robust legislative solutions to the lack of a coherent immigration policy. Many argued that Title 42 should have ended earlier, with more immigrants welcomed across the border. However, even some Biden supporters have worried about the resultant rise in immigrants. What the end of Title 42 reveals is that the United States has completely failed to find a legislative solution to the immigration question.
A History of Failed immigration Reform
As the New York Times reports , since the Clinton Administration, the United States has tried a number of legislative solutions to reform immigration policy. Each of the proposed solutions has either failed to earn the support of both the Democratic and Republican parties, or, even when the solutions have received bipartisan support, and received the backing of the president, they have still failed at the finishing line. Rather than revolution, what we have had is a series of stop-start patchwork reforms. Congress has shown no real appetite for reform and so, presidents have increasingly taken charge of the issue, using existing laws and executive powers to advance immigration reform. However, even this is limited because, beyond a certain amount, presidents need congressional approval to get more funding or reallocate capital. With a divided Congress, we are unlikely to see any meaningful immigration reform in this session. Speaker of the House, Kevin McCarthy (R-Calif.), in order to win his position, agreed to not allow an amnesty bill onto the House floor this session.
