Amend the Constitution to Correct Corrupt Supreme Court Justices [1]

The corruption of Supreme Justices Thomas and others should be corrected. One partial solution is to impeach these justices and remove them from the bench. The only deterrent against similar corruption by other justices is only the shame such a removal would create. A stronger deterrent is required to minimize future corruption.

An amendment to the Constitution seems to be the most effective method to achieve the goal of both removing a corrupt justice and providing a deterrent against future corruption. The deterrent I suggest is that when a justice is removed from the court, every vote eve r made by that justice since his or her first day on the Court shall be nullified. 5 to 4 votes would become 4 to 4. In matters of a tie, the issue before the court would revert to the status of that issue when it reached the Court. Negation of a justice’s entire legacy of voting would be a major humiliation, one which most people would want to avoid at all costs. Given the possibility of a justice having an opinion negated due to outside influence could also act as a deterrent to outside people trying to influence individual justices, as is the case with Thomas.

Should such a rule be in existence today and Thomas were to be removed from the court, decisions such as Citizens-United which passed by 5-4 due to the deciding vote of Thomas would be 4-4 and revert to the status prior to this issue going before the court. Recall also Thomas’ influence on the partial roll-back of our hard won civil rights legislation. Many will argue that reversing existing decisions will have a chaotic effect on this country. I would counter that by pointing out that decisions influenced by outside interests have caused significant chaos in this country with a prime example being Citizens-United, so adding chaos to correct bad decisions is acceptable if that is the only way to correct a corrupted decision. In addition, if some specific issues have merit, they can always be retried before the Court. Decisions influenced by powerful interests have eroded democracy and promise to have even greater effects in the future.

Thomas is only one Justice influencers have impacted. Chief Justice Roberts also appears vulnerable, and he is not the only Justice who may have been corrupted. Removal of these corrupt people and nullifying their votes should result in returning us to a country where democracy reigns supreme.

I am not naïve enough to believe that such an amendment could be passed in our partisan country of today- but - a strong effort should be made because we have lost too much under our existing lack of correction for corrupt people in positions of power and we need to regain what we have lost.
