CA-Sen: Majority Leader Schumer (D. NY) Hints That Feinstein (D) Could Be Back To Work By Next Week [1]

Dianne Feinstein (D-Calif.) will return to the Senate next week after speaking to her on the phone, according to a picture of his prepared notes for a Tuesday press conference. The document, headlined “DEBT CEILING DEFAULT,” that Schumer brought with him to the news conference, included a potential question on Feinstein’s future in the upper chamber. “With the new June 1 deadline, isn’t it time to tell Senator Feinstein she has to either return next week or resign?” the document, captured by Politico photojournalist Francis Chung, asks, in reference to the looming debt ceiling deadline. “I spoke with Sen. Feinstein yesterday,” the reply follows. “We are both hopeful she can return next week.”

“It was in his notes, and he would have said if someone asked,” Schumer’s spokesperson told POLITICO. Earlier on Tuesday Feinstein’s office told POLITICO that Feinstein “continues to make progress in her recovery” from shingles, but that her staff “don’t have a timeline yet for her return to Washington, which is dependent on her medical team saying it is safe to travel.” A Feinstein spokesperson confirmed the senator and Schumer spoke, originally confirming the majority leader’s notes that the conversation occurred Monday and later saying that it happened Sunday night. Senate Republicans blocked an attempt by Democrats last month to temporarily replace Feinstein on the Judiciary panel. House Democrats, including Reps. Alexandria Ocasio-Cortez (D-N.Y.), Rashida Tlaib (D-Mich.), and Ro Khanna (D-Calif.) have called on Feinstein to resign before the end of her term to allow a replacement to be appointed.

While I understand Feinstein’s situation, she needs to get back to work, confirm these judges, help raise the debt ceiling and then she should resign and allow Governor Newsom to appoint her replacement. That would be the honorable way to end her incredible legacy in the U.S. Senate.

But just in case, President Biden is already working on a back up plan:

Zoom in: Today the president plans to name Loren L. AliKhan for the district court of the District of Columbia, Susan K. DeClercq for the eastern district of Michigan, Julia K. Munley for the middle district of Pennsylvania; and Vernon D. Oliver for the district of Connecticut. If confirmed, AliKhan would be the first South Asian woman to serve on the D.C. district court. DeClercq would be the first of East Asian descent in Michigan. The big picture: Biden has made it a priority to stock the federal judiciary with judges who are young, progressive and diverse. But so-called Senate "blue slips" — which give senators enormous power over nominees from their home states — can complicate Biden’s ambitions.

At the same time, the Judiciary Committee doesn’t have a functioning majority with Feinstein out, further hindering Biden's plans. What’s happening: Biden officials are now placing a higher premium on winning home-state senators' support well before a nomination is public. That has allowed the vetting process to begin for new candidates.

In April, Biden nominated — with support from Texas Republican Sens. Ted Cruz and John Cornyn — Judge Irma Carillo Ramirez to the 5th U.S. Circuit Court of Appeals.

In Louisiana, Biden nominated Darrel Papillion — with backing from Louisiana Republican Sens. John Kennedy and Bill Cassidy — to serve as a U.S. district judge in Louisiana.

Might as well at least force Republican Senators to vote for or against their own nominees.

Meanwhile, in the race to succeed Feinstein, I want to give all three major Senate candidates a huge shout out for this:
