Speaker McCarthy;

I am concerned about the March 20, 2023 letter (copy attached) you directed Rep. Jim Jordan, Chair of the Committee on the Judiciary, Rep. James Comer, Chair of the Committee on Oversight and Accountability, and Rep. Bryan Steil, Chair of the Committee on House Administration to send to Mr. Alvin L. Bragg, Jr., Manhattan District Attorney.

The letter threatens to interfere with D.A. Bragg’s investigation into an alleged hush money payment to hide an alleged affair from voters who might have turned away from the then-candidate and current leader of the Republican Party in the days before the 2016 presidential election.

Unfortunately, Jordan, Comer, and Steil failed to acknowledge that Congress has no legitimate legislative reason to investigate a state district attorney, and, at the same time, they ignored the obvious fact that the Tenth Amendment says, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

In your haste to mollify MAGA voters to reduce your chances of being subjected to primary challenges before the 2024 election, you, Jordan, Comer, and Steil may have violated New York Penal Law § 195.05, Obstructing governmental administration.

The overreaching problem here, Speaker McCarthy, is that voters did not give Republicans the House majority, so you, Jordan, Comer, and Steil could use that mandate to interfere in a criminal investigation, no matter how much political sway the target of that investigation may have.

The voters gave Republicans the House majority to use its power to resolve pressing issues that impact the lives of all Americans, not just a favored few.

Many may say that I’m expecting too much, but I sincerely hope that you and your caucus will finally come to your public servant senses and do the jobs taxpayers pay you to do and never again put political self-interest ahead of the needs of the American people.
