Historical evidence a President or Vice President can be arrested for treason.
1807 former Vice President of the USA Aaron Burr was arrested for Treason. He was Vice President from 1801 to 1805.. Burr had conspired with Farmers, Land owners, Army Officials and Politicians to create and independent Nation in the American Southwest and Mexico. Much of this land area MEXICO was forced to sell off after a war to the USA in 1836.
The conspiracy somehow was discovered. Many of the documents and letters sent by Burr were found. They were used as evidence in the trial detailing their plot.
The trial was presided over by Chief Justice John Marshall. Arron Burr was being Tried for Treason. However the Chief Justice redefined and narrowed the definition of Treason. Thereby allowing the jury to acquit Arron Burr. Never the less Arron Burr humiliated left the USA for Europe in disgrace.
