Last January 13, I wrote “Why We Can’t Prosecute The Former Guy Yet. (

I thought I made it pretty clear. Apparently not. So here we go again. In addition to the twenty reasons enumerated before, which showed why it was not propitious to prosecute The Former Guy, now we will change focus and it should be plain as day it’s still: Why We Can’t Prosecute The Former Guy Yet -that is the only correct stance.
There have been numerous comments and yes, even whole diaries written to say it’s wrong-headed to expect that after the January 6th Committee issued its report, explicitly calling on the Justice Department to prosecute The Former Guy and his henchmen on four very specific counts:
Obstruction of an official proceeding.
Conspiracy to defraud the United States.
Conspiracy to knowingly make a false statement.
Assisting, aiding or comforting an insurrection.
..and these specific charges were backed up with testimony and evidence in the sessions of the January 6thCommittee and laid out in detail in their report. A Federal Judge could invoke the 14thAmendment and prevent The Former Guy from running for office, which yes, was pretty much the objective, and it can’t be done with any other charges, not with Littering, Loitering, Looting or Lascivious Behavior no matter how justified the charge is. These obstruction and conspiracy crimes were done in broad daylight with written evidence, with video evidence, with phone, e-mail and document evidence, in front of witnesses, and were planned with people who have already been convicted of conspiracy to obstruct the government, but the Department of Justice just can’t proceed. Why? You dare ask Why?
Now it’s not that isn’t propitious. It still isn’t, but we covered that. It’s that the Department of Justice (DOJ) is just Too Darn Busy!
This time I will concentrate on all the chores-innumerable, uncountable, like stars in the universe or sand grains on the shore - yet vital tasks -that keep Merrick Garland from job #1, the job which will keep our democracy. I will number them, as before, for everyone’s convenience:
1. The wheels of justice grind slowly but exceeding fine! Did you think this was some sort of tired worn aphorism? No. That’s how it is. No one can change it. You could learn something here.
2. Groundhog Day (not the movie, Jerk.) Don’t you want to know if we’re getting six more weeks of winter? DOJ agents do. No arresting people if the temperature dips below 40°. It’s in their work contract. This means good weather days are overloaded.
3. February3rd...The Day The Music Died. Have you NO respect?
4. Girl Scout Cookies. For people out of the loop here or who live in places too rural to have Girl Scouts visit, this is the time when all the good Dads at DOJ are helping their daughters sell cookies. You want to ruin the father daughter relationships for all these guys? What’s that? Yeah? Well, rightback atcha Buddy!
5. High level activity before, during, and after the State of the Union Speech. It just looked like Merrick Garland sat placidly (sometimes standing placidly) during the whole thing. You would be amazed at the fast and furious multitasking that was going on. Yes. Amazed. You.
6. Daylight Saving Time is still three weeks away! Criminy! There are are only so many hours in the day! Back off, you Oppressors!
7. Valentine’s Day: The search for The Right Card began as soon as they appeared on the racks on December 26th. Oh, you think that’s frivolous? Yeah, sure, step right up and take the blame for someone’s divorce, Moron.
8. National Future Farmers of America (FFA) Week. This year it’s from February 18th to 25th, and it’s a must- attend for all upper staff. Secretary of Agriculture Tom Vilsack can get pretty testy if he feels slighted in any way, as DOJ found out last year when no one from Justice showed up at the Manure Judging Expo in Pomeroy, Iowa…
9. The DOJ was ready to move on The Former Guy, and take him into custody at Mar-a-Lago, but then they saw him kneeling, maybe in prayer? The Lead Agent worried that The Former Guy might have Heaven on his side if they arrested him then, while praying. It was much ado about nothing, though, as the The Former Guy had just dropped a cufflink. Missed the chance. Tragic.
10. Lent. Many people in the DOJ give up prosecuting people for Lent. Hey! We have Freedom of Religion here, so shut up.
11. Emergent weed spraying All hands will be needed. You didn’t know that the DOJ Building -The Robert Kennedy Building -was in a HOA? Shows what you know.
12. Relax! We’ve got six years before the Statute of Limitations expires on any of The Former Guy’s crimes is up and, therefore, DOJ has lots of time before they have to do anything. So what does that really mean? Well, it means they probably don’t have to anything ever! So, the pressure is off! Six years from when this was written -February 18, 2023 -will be February 18th 2029. That’s 29 days into Donald Trump’s 3rd term as President, not that it matters, of course, as by then he will be President for Life, and Vice President Don Jr. is solidly in the line-up to succeed him. Both may have done many, many obstructions of justice by then but no one’s counting, and especially not counting will be United States Attorney General Sydney Powell. Too bad about what happens to Ukraine, eh?
13. Extra reason: Because I said so.
There you have it...A baker’s dozen of stuff showing Why We Can’t Prosecute The Former Guy.
So, see? Time is on the side of Justice...way over there, on the side, behind that potted plant...No,no! The big potted plant by the...am I going to have to come over there and show you where it is? Oh! Honest ta’ Pete, You People!
Post Script: If I wake up tomorrow and the DOJ has already arrested The Former Guy,never mind. Look out your window. That person dancing in the street is me, or close enough.
