WASHINGTON, Jan. 25, 2023 — The U.S. Department of Agriculture (USDA) today finalized protections for the Tongass National Forest in Alaska, the world’s largest intact temperate rainforest. USDA’s final rule, announced today, repeals the 2020 Alaska Roadless Rule and restores longstanding roadless protections to 9.37 million acres of roadless areas that support the ecological, economic and cultural values of Southeastern Alaska. On his first day in office, President Biden committed to reviewing rules – such as the 2020 Alaska Roadless Rule – that may conflict with important national objectives including protecting the environment. This action is among a series of steps the Biden-Harris Administration has taken to conserve and restore some of America’s most cherished lands and waters, many of which are sacred to Tribal Nations. “As our nation’s largest national forest and the largest intact temperate rainforest in the world, the Tongass National Forest is key to conserving biodiversity and addressing the climate crisis,” said Agriculture Secretary Tom Vilsack. “Restoring roadless protections listens to the voices of Tribal Nations and the people of Southeast Alaska while recognizing the importance of fishing and tourism to the region’s economy.” At 16.7 million acres, the Tongass National Forest represents the largest intact tract of coastal temperate rainforest on earth and is considered critical for carbon sequestration and carbon storage to help mitigate climate change. America’s forests are a key climate solution, absorbing carbon dioxide equivalent to more than 10% of U.S. annual greenhouse gas emissions.

The FBI and law enforcement in Europe have shut down a major ransomware operation accused of extorting more than $100 million from organizations across the world by encrypting victims’ computer systems and demanding payments to provide a key to unlock them, U.S. officials said Thursday. Attorney General Merrick Garland said the ransomware group called Hive attacked hospitals, school districts, financial firms and others, stealing and sometimes publishing their data. Like some other prolific groups, Hive partnered with independent hackers who broke in through phishing or other means: The gang provided the encryption program and ransomware negotiations, and split the profits with the hackers. In one August 2021 case, a nonprofit Ohio network of hospitals had to cancel urgent surgeries as its staff moved to paper charts. Other victims included a Florida heavy machinery company that had to shut down temporarily, multiple law firms, and a New Jersey tech company whose customers had their data stolen, according to an FBI affidavit

Broadband coming to Kansas Jerick Tafoya, 12news

TOPEKA, Kan. (WIBW) - On January 18, 2023, Governor Laura Kelly announced that $44.5 million will be awarded to nine service providers to extend high-speed internet to 18,468 locations in 15 underserved counties across the state. This will be the third and final award phase of the Kansas Capital Project Funds (CPF) Broadband Infrastructure Program. The CPF program provides funding to establish broadband connections in critical areas of the state that lack high-speed internet access. According to the governor’s office, the total CPF investment of $83.5 million and nearly $42 million in matching funds will result in more than 24,500 homes, businesses, schools, healthcare facilities, and other public institutions being connected to fast, reliable internet for the first time. Governor Laura Kelly said, “The Capital Projects Fund represents a giant step toward getting every Kansan connected to high-speed internet. With this funding, we’re closer than ever to reaching our goal of making Kansas a top 10 state for broadband access by 2030.”

DirecTV drops NewsMax Patrick T Fallon, New York Daily News

Many right-wing media consumers got a surprise Wednesday morning when they turned on their televisions to find Newsmax was no longer on the air. The far-right-leaning cable station was cut from DirecTV’s lineup at midnight after negotiations between the satellite service and the media outlet fell apart. “On multiple occasions, we made it clear to Newsmax that we wanted to continue to offer the network, but ultimately Newsmax’s demands for rate increases would have led to significantly higher costs that we would have to pass on to our broad customer base,” a DirecTV representative told the Daily News in a statement. “We continually evaluate the most relevant programming to provide our customers and expect to fill this available channel with new content.”

Thousands of Australians protested Thursday the Australia Day national holiday marking the anniversary of a British fleet landing in the country for the first time on Jan. 26, 1788. Why it matters: There are calls to change the date of the annual event that's also known as "Invasion Day," because of the devastating impact colonialism and its racist legacy had on Aboriginal and Torres Strait Islander Australians who'd lived in the country for tens of thousands of years before the British arrived — or abolish it altogether. This year's protests are particularly poignant because of an upcoming referendum on whether to enshrine in the Australian constitution an Indigenous voice to Parliament.

A border bill that would grant the secretary of Homeland Security the power to deny entry to any foreign citizen has been delayed after opposition from moderate Republicans, including Rep. Tony Gonzales (R-Texas).

But Biden and the Ds plan to use some of these R proposals, even if they don’t get very far, against them.

A trio of freshmen House Democrats is asking House Speaker Kevin McCarthy (R-Calif.) and Minority Leader Hakeem Jeffries (D-N.Y.) to organize a classified briefing on mass shootings, according to a letter obtained by Axios. Why it matters: The move follows a string of mass shootings in recent weeks and demonstrates how some new Democratic lawmakers — striving to show constituents they are making an impact in Washington — are trying to maneuver around the legislative roadblocks of being in the minority. Driving the news: Reps. Jared Moskowitz (D-Fla.), Maxwell Frost (D-Fla.) and Dan Goldman (D-N.Y.) — three vice chairs of Congress' Gun Violence Prevention Task Force — asked Jeffries and McCarthy to seek a briefing from the FBI and "other relevant agencies."

🌻 Biden’s decision to send tanks to Ukraine receives bipartisan support Ellie Sennett, The National News

The US is sending 31 of its sophisticated M1 Abrams tanks to Ukraine after months of diplomatic and defence talks, officials announced on Wednesday. The move comes after Germany earlier said it would send an initial 14 Leopard 2 battle tanks to Ukraine and the UK announced it would send 14 Challenger 2 tanks, in joint moves the White House hailed as “closely co-ordinated”. “The United States and Europe are fully united,” said President Joe Biden in White House remarks announcing the Abrams shipments. He also praised enhanced support for Kyiv across Europe. ✂️ The administration's decision to send the Abrams tanks was quickly met with bipartisan support from a usually polarised Congress. Republican Senator Lindsey Graham, who had called for the tank shipments earlier in the week, said he was “very pleased”.

Note that it is bipartisan, not universal. Some of the MOCs apparently support Russia.

As Biden has replenished the reserves at a lower price, he has actually made about 4 billion for the US taxpayers on these deals. Note that I have not done the numbers myself.

Tax-exempt organization complaint referrals. 13909. You can fill this out for the NRA and lots of other organizations. How about if some of us white folk go into some of the MAGA churches and video record what they’re saying?

Voting rights. This may be the biggest issue threatening our democracy right now. Besides contacting your representatives at the state and federal level to do the right thing (depending on who they are), you can support and contact these organizations:

Democracy Docket — founded by Marc Elias, so important in fighting the challenges after the last election.

Fair Fight — founded by Stacey Abrams

🌱Grass roots. Biden and Harris can do the top-down stuff, but we have to support from the bottom. I don’t know how to deprogram 75 million people, but some things have been written about, such as deep canvassing, and lots of people are talking about this. If you know someone (who did not storm the Capitol), then see if you can be pleasant. Instead of trying to reason with them (logic is obviously not their strong point) distract them with something else. We need to remove the sources of lies and to take down the temperature. If we get more of the Rs to wear masks and to get vaccinated and to vote for Ds, the country will be a better place. We need to coax some of them out of the rabbit holes and diffuse the anger and the crazy.

🏃 Run for something. If you want to run for something, but have no idea what to do, these people will help you. They also like money and volunteers to help those people who are running, so even if you’re not in a position to stand for office, you can help. Note: they are especially planning to target the 57 Rs in local governments who participated in the insurrection.

👎 Defund the seditionists. Defund the seditionists. This is a list with companies that sometimes have donated to the seditionists. The list is long. You will recognize many of the corporations, and you probably have a relationship with some — either you are a customer, a shareholder, or maybe even an employee. Contact them and compliment or complain, but let them know you are watching. Forward it to others.

California bar moves to nix John Eastman’s law license Josh Kovensky, Talking Points Memo

The California state bar moved to revoke attorney John Eastman’s law license on Thursday, saying that he lied over and over again to support President Trump’s effort to stay in office after losing the 2020 election. The chief trial counsel of the California bar slapped Eastman with eleven counts of violating attorney ethics rules during the effort. They include eight counts of moral turpitude, two counts of trying to mislead a court, and one count of failing to support the laws and Constitution of the United States. Eastman, the bar said, either knew or was negligent in not knowing “that there was no evidence upon which a reasonable attorney would rely of election fraud or illegality that could have affected the outcome of the election, and that there was no evidence upon which a reasonable attorney would rely that the election had been ‘stolen’ by the Democratic Party or other parties acting in a coordinated conspiracy to fraudulently ‘steal’ the election from Trump.”

Driving the news: Europe's heavy dependence on Russian gas, which once provided 40% of EU supplies, has been rapidly severed. Now it only accounts for about 14.4% of EU supplies, per S&P Global Commodity Insights. How it works: European gas prices soared to record levels, but have since fallen back to below pre-war levels. That's partly thanks to more supplies from the U.S. and elsewhere, but it's also because of planning.

Last year’s trucker convoy protests threatened to storm into the nation’s capital, but ended with a whimper in May as the group disbanded amid intense infighting. However, in recent days, the movement was reawakened by text message “scammers” calling for the truckers to join a multi-level marketing scheme. On Saturday, people who had given their phone numbers to the “People’s Convoy” group received an anonymous text message. “Hi Patriot friends!!! Biden is killing us at the pump, we have some help for you!” the message said. This offer to the convoy patriots was not another plan to take over Washington. Instead, it was a decidedly questionable business opportunity that was quickly disavowed by some of the group’s organizers.

BREAKING: John Durham and Bill Barr are some of the corruptest sumbitches ever to wander the streets of DC. Must credit Wonkette! LOL, and also holy shit! The New York Times has a story (Wonkette gift link) on the brazen corruption baked in to the appointment of Special Counsel John Durham to INVESTIGATE THE INVESTIGATORS and browned to crispy, golden perfection as the two tried every which way to prove that the inquiry into the Trump campaign's ties to Russia was somehow inappropriate and illegal. "[T]he main thrust of the Durham inquiry was marked by some of the very same flaws — including a strained justification for opening it and its role in fueling partisan conspiracy theories that would never be charged in court — that Trump allies claim characterized the Russia investigation," writes the New York Times, in what has to be the understatement of the year. In fact, the Durham investigation was an uncanny mirror of every corrupt thing Trump and his allies accused the FBI of doing. Because if there's one thing we've learned in the past seven years, it's that every single Trump accusation is a confession — or at least an announcement of crimes they intend to commit real soon.

Interviews by The Times with more than a dozen current and former officials have revealed an array of previously unreported episodes that show how the Durham inquiry became roiled by internal dissent and ethical disputes as it went unsuccessfully down one path after another even as Mr. Trump and Mr. Barr promoted a misleading narrative of its progress. Mr. Barr and Mr. Durham never disclosed that their inquiry expanded in the fall of 2019, based on a tip from Italian officials, to include a criminal investigation into suspicious financial dealings related to Mr. Trump. The specifics of the tip and how they handled the investigation remain unclear, but Mr. Durham brought no charges over it. Mr. Durham used Russian intelligence memos — suspected by other U.S. officials of containing disinformation — to gain access to emails of an aide to George Soros, the financier and philanthropist who is a favorite target of the American right and Russian state media. Mr. Durham used grand jury powers to keep pursuing the emails even after a judge twice rejected his request for access to them. The emails yielded no evidence that Mr. Durham has cited in any case he pursued. There were deeper internal fractures on the Durham team than previously known. The publicly unexplained resignation in 2020 of his No. 2 and longtime aide, Nora R. Dannehy, was the culmination of a series of disputes between them over prosecutorial ethics. A year later, two more prosecutors strongly objected to plans to indict a lawyer with ties to Hillary Clinton’s 2016 campaign based on evidence they warned was too flimsy, and one left the team in protest of Mr. Durham’s decision to proceed anyway. (A jury swiftly acquitted the lawyer.)

📣 Let’s Honor Truth ☀️️

This week we’re honoring a Donald, not the defeated former guy, but Judge Donald Marsh Middlebrooks, who really slammed tRump et al in a decision issued January 19, 2023. tRump was suing Clinton (and others) for Russian reasons. First, Judge Middlebrooks slammed tRump and lawyer (Alina Habba) with a joint and several fine of nearly one million, which got tRump to withdraw a suit against Letitia James. You’ve probably seen those headlines. But you may have not seen these choice quotes from the document (public, no issue with fair use):

This case should never have been brought. Its inadequacy as a legal claim was evident from the start. No reasonable lawyer would have filed it. Intended for a political purpose, none of the counts of the amended complaint stated a cognizable legal claim.

Thirty-one individuals and entities were needlessly harmed in order to dishonestly advance a political narrative. A continuing pattern of misuse of the courts by Mr. Trump and his lawyers undermines the rule of law, portrays judges as partisans, and diverts resources from those who have suffered actual legal harm. ✂️ I find that the pleadings here were abusive litigation tactics. The Complaint and Amended Complaint were drafted to advance a political narrative; not to address legal harm caused by any Defendant.

The 819 paragraphs of the 186-page Amended Complaint are filled with immaterial, conclusory facts not connected to any particular cause of action. Consider the incendiary charge that Mr. Comey, the Director of the FBI, conspired with Ms. Clinton to maliciously prosecute him. Leaving aside the fact that Mr. Trump was never prosecuted, examine the allegations in the Amended Complaint pertaining to Mr. Comey. The first mention of Mr. Comey, other than identifying him as a party, was in paragraph 349: “Therefore, senior FBI officials Comey, McCabe, Page, Strzok, the DNC and Clinton orchestrated a plan to falsely accuse Flynn of colluding with Russia to protect the potential dissemination of the intimate details of their plot.” ✂️ And the implausible claim that Mr. Comey conspired with Ms. Clinton, given the impact of his announcements on her 2016 campaign, not only lacks substance but is categorically absurd.

The Amended Complaint is a hodgepodge of disconnected, often immaterial events, followed by an implausible conclusion. This is a deliberate attempt to harass; to tell a story without regard to facts. ✂️ The Plaintiff consistently misrepresented and cherry-picked portions of public reports and filings to support a false factual narrative. Often the report or filing actually contradicted his allegations. It happened too often to be accidental; its purpose was political, not legal. ✂️ Mr. Trump’s deliberate use of a frivolous lawsuit for an improper purpose constitutes bad faith. And the behavior is not unique, but part of a plan, or at least a playbook. The telltale signs:

• Provocative and boastful rhetoric;

• A political narrative carried over from rallies;

• Attacks on political opponents and the news media;

• Disregard for legal principles and precedent; and

• Fundraising and payments to lawyers from political action committees.33

And when a ruling is adverse, accusations of bias on the part of judges—often while the litigation is ongoing. ✂️ Having determined that sanctions are appropriate under inherent authority, I must now determine what those sanctions should be. I find that an award of Defendants’ attorneys’ fees and costs is a fair and just sanction given Plaintiff’s and his counsel’s actions in this case. Footnote 38, on last page — a way to get out of it! “[S]anctions must never be hollow gestures: their bite must be real.” Martin v. Automobile Lamborghini Exclusive, Inc., 307 F. 3d 1332, 1336 (11th Cir. 2002). But for the bite to be real it must be an amount a person can pay. Id. I believe the monetary sanctions imposed here are well within Plaintiff and Plaintiff’s lawyer ability to pay, and therefore I have not thought it necessary to conduct an intrusive inquiry into their finances. However, should Plaintiff or Plaintiff’s lawyer (and law firm) believe that the amount would seriously jeopardize their financial status, see, e.g., Baker v Alderman, 158 F. 3d 516 (11th Cir. 1998), that individual or firm should file within ten (10) days of this Order, under seal, a verified statement of net worth which includes assets and liabilities. In the event of such a filing, the obligation of that individual or law firm will be tolled until further order of the Court.

Record renewables in Australia for 2022 4th Q Olivia Rosana EcoWatch

During the last three months of 2022, the country broke records for high renewable activity, low energy demand and low greenhouse gas emissions, according to an Australian Energy Market Operator (AEMO) report published Wednesday. New utility-scale wind and solar development meant the two energy sources alone generated 20 percent of the NEM’s energy from October through December. “This growth, along with the lowest output from coal-fired generation since NEM start (down 926 MW from Q4 2021), saw NEM emissions drop to the lowest quarter on record at 26.4 million tonnes carbon dioxide equivalent – 5.6% lower than Q4 2021 levels,” AEMO Executive General Manager of Reform Delivery Violette Mouchaileh said in a press release. She added that the emissions of the Wholesale Electricity Market (WEM) also fell by 11 percent compared to the fourth quarter of 2021.
