The Hypocrisy of John Roberts and his Supreme Court. [1]

Race and ethnicity, unfortunately, still matter in the USA today.

Barring some unforeseen miracle, it is almost certain that Chief Justice John Roberts and his ideologically-driven conservative US Supreme Court majority will quash the decades-old precedent that has allowed colleges and universities to consider a student’s race as one of the criteria for admission, in an effort to improve campus diversity, the students' total education experience and society as a whole.

Repealing or scaling back the 1978 landmark that first endorsed the use of race in academic admissions, however, would be a mistake.

The Supreme Court need only look to itself to see that race, ethnicity and gender still do matter today and will for the foreseeable future.

One of the few bright sparks of today’s Supreme Court, considering that the majority of Americans have lost trust in it, is that the Court, to a large extent, reflects the diversity of its citizens. It’s not perfect but great strides have been made.

But this wouldn’t have happened if presidents, mostly Democratic, hadn’t actively taken the decision to nominate future justices to build this diversity in skin colour, faith, ethnicity and gender.

For example, only a naive person would believe that the colour of his skin wasn’t one of the primary reasons why Justice Clarence Thomas was chosen to replace Justice Thurgood Marshall, a civil rights champion and the first African American to be appointed to the Supreme Court after 180 years of white males. And President Biden actively promised that he would appoint the first African American woman to the Court when given the opportunity. And he did with Justice Ketanji Brown Jackson taking her place among the nine justices.

Every time a nomination for the Supreme Court comes up, there are many candidates that could be chosen. Some, I’m sure, may even be more qualified or more experienced than the candidate that is finally put forward for confirmation by the Senate.

It is no different for colleges and universities. But by taking away their right to build the student populations that they wish, the Court will be hampering one of the fundamental obligations that academic institutions have: to build a more equal society and to grow the leadership that will carry these ideals forward.

Let’s hope that common sense prevails. For all our sakes.
